ORDER OF PUBLICATION Plaintiff seeks to partition that certain piece and parcel of land situate in Cabell County, which more fully and particularly described as follows: All that certain lot, piece or parcel of ground lying and being situate in Barboursville District, Cabell County, West Virginia, known and designated upon a certain revised map of Fair Grounds Addition to Barboursville, Cabell County, West Virginia, a copy of which said map was filed and recorded in the Office of the Clerk of the County Court of Cabell County, West Virginia, on October 11, 1923, in Map Book No. 2 as Map No. 244, as Lots Numbers Forty-Seven (47), Forty-Eight (48) and Forty-Nine (49). EXCEPTING AND RESERVING the northerly portion of said lots which northerly portion is more particularly described as follows: BEGINNING at an old hub by a fence post on the east side of Division Road, said hub being the northwesterly corner of Lot 49 of the Fair Ground Addition, a map of which is found in Deed Book 199, Page 450, also in Map Book 2, Page 244, and running thence with the east side of Division Road, S. 3 13′ E. 33.0 feet; thence S. 88 22′ E. 135.54 feet to a point in an old fence line between Lots 46 and 47 of above mentioned subdivision; thence with the line between Lots 46 and 47, N. 2 21′ E. 97.07 feet to the northeasterly corner of Lot 47; thence with the north line of said subdivision S. 66 10′ W. 151.8 feet to the BEGINNING, leaving the southerly portion of Lots 47, 48 and 49. It appearing by an affidavit of record in this civil action that the Plaintiff has used due diligence to ascertain the whereabouts of the Defendant, without success, it is hereby ORDERED, that Defendant named hereinabove serve upon William G. Jones, Plaintiff’s attorney, whose address is 1002 Third Avenue, P. O. Box 1835, Huntington, West Virginia 25719, an answer or other defense to the Complaint initiating this civil action on or before the 1st day of June, 2020, otherwise judgement by default will be taken against Defendant at any time thereafter.
