NOTICE OF SUBSTITUTE TRUSTEE’S FORECLOSURE SALE NOTICE is hereby given that by virtue of the authority vested in the undersigned Substitute Trustee by that certain Deed of Trust dated March 31, 2006, executed by Duane Mills and Kris Mills, husband and wife, to Michelle Harda, Trustee, and recorded on April 20, 2006, in Trust Deed Book Number 3348 at Page 274, in the Office of the Clerk of the County Commission of Kanawha County, West Virginia; and a Corporate Assignment of Deed of Trust dated October 30, 2008, and recorded on November 12, 2008, in Book 224 at Page 36, in the Office of the Clerk of the County Commission of Kanawha County, West Virginia; and re-recorded Corporate Assignment of Deed of Trust dated October 30, 2008, and recorded on November 26, 2012, in Book 238 at Page 626, in the Office of the Clerk of the County Commission of Kanawha County, West Virginia; and a Substitution of Trustee dated October 25, 2006, and recorded on November 2, 2006, in Book 3409 at Page 71, in the Office of the Clerk of the County Commission of Kanawha County, West Virginia; and a Substitution of Trustee dated October 30, 2008, and recorded on December 11, 2008, in Book 3613 at Page 652, in the Office of the Clerk of the County Commission of Kanawha County, West Virginia; and a Substitution of Trustee dated October 22, 2012, and recorded on November 26, 2012, in Book 3916 at Page 772, in the Office of the Clerk of the County Commission of Kanawha County, West Virginia; and a Substitution of Trustee dated May 19, 2014, and recorded on July 17, 2014, in Book 4041 at Page 844, in the Office of the Clerk of the County Commission of Kanawha County, West Virginia; and an Appointment of Successor Trustee dated December 5, 2016, and recorded on January 25, 2017, in Book 4220 at Page 317, in the Office of the Clerk of the County Commission of Kanawha County, West Virginia; and a Substitution of Trustee dated February 28, 2018, and recorded on April 10, 2018, in Book 4299 at Page 72, in the Office of the Clerk of the County Commission of Kanawha County, West Virginia; and a Loan Modification Agreement dated August 18, 2014; and that certain Substitution of Trustee, Fred G. Staker, III, a resident of Cabell County, West Virginia, dated February 21, 2020, and recorded on March 11, 2020, in Book Number 4412 at Page 374, in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, by which Deed of Trust referenced above the said grantors, Duane Mills and Kris Mills, conveyed unto the said Trustee, the hereinafter described real estate to secure payment of a certain Promissory Note set out and described therein, and default having been made in the payments of said Promissory Note, and the said Substitute Trustee, Fred G. Staker, III, having been requested in writing to do so by the owner and holder of said Promissory Note, the undersigned Substitute Trustee, Fred G. Staker, III, will sell to the highest bidder on FRIDAY, JUNE 5, 2020 AT THE HOUR OF 11:00 O’CLOCK A.M. at the front door of the Courthouse of Kanawha County, located within the City of Charleston, State of West Virginia, the following described real estate, TO WIT: All that certain lot and parcel of real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate in Washington District, Kanawha County, West Virginia, and being all of Lot No. Four (4), of Southpointe, as the same is shown on that certain plat entitled “PLAT SHOWING SOUTHPOINTE A RESIDENTIAL SUBDIVISION SITUATE ON THE EAST SIDE OF US ROUTE 119 BETWEEN BIG COAL RIVER AND BIG BRANCH OF COAL RIVER FIVE MILES SOUTH OF SOUTHRIDGE CENTRE WASHINGTON DISTRICT, KANAWHA COUNTY, WEST VIRGINIA” dated October 2, 1995, of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Map Book 50, at page 91. Parcel/Map No. 16 0026 0005 0000 PHYSICAL ADDRESS: The physical address and location of the subject real property is 4 EAST COVE LANE, CHARLESTON, WEST VIRGINIA 25309. TERMS OF SALE: Cash in hand on the day of sale. The sale shall be subject to any and all outstanding property taxes and assessments and all prior liens and encumbrances of record and otherwise, if any. The Substitute Trustee does not warrant title to the subject property. The purchaser shall be responsible for the payment of all transfer taxes imposed by Article 2 of Chapter 11 of the Official Code of West Virginia, as amended. The subject property will be sold in an “AS IS” and “WHERE IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate the said property. The Substitute Trustee will deliver a Trustee’s Deed to the Purchaser without any covenant or warranty (express or implied) in the form prescribed by WV Code Section 38-1-6, as amended.
