NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated September 14, 2012, executed by Borrower, Carloess Duane Stowers, to Vance Golden, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 3901, at Page 235. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 28 Welcome Ln, Charleston, WV 25306. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 26, 2020, of record in the Clerk’s Office in Book 4411, Page 523. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 26th day of May, 2020 at 11:15 a.m. All those certain lots, pieces or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate on Campbell`s Creek, in Malden District, Kanawha County, West Virginia, as shown on a map entitled “Mortgage Verification of Lot “F” of Bert Wentz Tract & Adjacent Parcel of Land Located on Campbell’s Creek, Malden District, Kanawha Co., WV for C. Duane Stowers” revised October 2, 1996, and prepared by David E. Thomas, Licensed Land Surveyor WV License No. 30, attached hereto for all pertinent purposes, with said parcels bounded and described as follows: PARCEL NO. 1: BEGINNING at a point on north side of Campbell’s Creek Road at the beginning corner of the parcel of land being described in deed from A. J. Salisbury and Sarah J. Salisbury to Bert Wentz dated February 6, 1953, and recorded in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 1249, at page 37, and running from said beginning point, N. 46 30` W. 113.39 feet to a point; thence S. 42 02` W. 62.39 feet to an iron pin and continuing on in said straight line in all a distance of 74.39 feet more or less to a point; thence S. 3 06` E. 68.78 feet to a point; thence S. 35 15` W. 48.08 feet to a point; thence S. 45 46` E. 26 feet, more or less, to a point in the northerly line of the Campbell’s Creek Road; thence with the northerly line of said road, N, 56 26` E. 52 feet, more or less, to a point; thence N. 51 37.5` E. 119.70 feet, more or less, to the point of beginning. PARCEL NO. 2: All of Lot “F” of the “Partition Survey of Bert Wentz Tract” as shown on map recorded in the aforesaid Clerk`s Office in Photostatic Map Book 27, at page 61. And being the same property conveyed unto C. Duane Stowers and LaDonna C. Stowers, husband and wife, by Donne Sue Wentz Nutter, as Executrix of the Estate of Cleo Patra Wentz, by deed dated October 2, 1996, of record in the aforesaid Clerk’s Office in Deed Book 2396, at page 746. For the consideration aforesaid and as an appurtenant to the land hereby conveyed, the said party of the first part does hereby grant all of the right, title and interest in the twelve (12) foot wide right of way set forth in a deed conveyance from A. I. Salisbury and Sarah J. Salisbury, his wife, to Bert Wentz, dated February 6, 1953, of record in the aforesaid Clerk`s Office in Deed Book 1249, at page 37. This conveyance is made subject to any and all covenants, restrictions, and easements as the same may appear in instruments of record in the aforesaid Clerk`s Office. Being the same property conveyed to Carloess Duane Stowers by the Deed dated October 2, 1996 and recorded in Deed Book 2396 at Page 746 in the Office of the Clerk of the County Commission of Kanawha County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
