TO: CG&H LLC 115 SPRING STREET CHARLESTON, WV 25302 NOTICE OF SALE Under authority of a certain A Deed of Trust dated May 15, 2015, from CG&H Limited Liability Company to Anthony Marks and Ronald D. Beane, Trustees, securing First Bank of Charleston, Inc., now known as Premier Bank, Inc., in the amount of $1,067,200.83, of record in the aforesaid Clerk’s Office in Trust Deed Book 4100, at page 240, default having been made in the payment of the obligation secured by said Deed of Trust, and sale having been requested in writing by the holder of the indebtedness secured, the undersigned, Raymond G. Dodson, Substitute Trustee, by virtue of Notice of Substitution of Trustee dated April 24, 2020, and recorded in the aforesaid Clerk’s Office in Trust Deed Book 4420 at page 54, will offer for sale at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on June 4 2020, at 11:00 o’clock, the certain real estate conveyed in said Deed of Trust, commonly known as 115 Spring Street, Charleston, West Virginia, which is further founded and described as follows: All of the following described real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Charleston, Charleston West Tax District, Kanawha County, West Virginia, and being more particularly described as follows: PARCEL NO. 1: BEGINNING at a stake on Pennsylvania Avenue, being a corner of a lot now or formerly owned by A. F. Daddysman, 16 feet east of the common corner of Lots 24 and 25 of Block “O” of Glen Elk Bottom Land; thence with the eastern line of the Daddysman lot and parallel with the division line between said Lots 24 and 25 in a northerly direction 150 feet to an alley; thence in an easterly direction with the line of said alley 34 feet to a stake, common corner of Lots 25 and 26 Block “O” of said Glen Elk Bottom Land; thence in a southerly direction with the division line between Lots 25 and 26, Block “O”; 150 feet to Pennsylvania Avenue ; thence with the line of Pennsylvania Avenue in a westerly direction 34 feet to the beginning. PARCEL NO. 2: BEING all of Lot No. 26, in Block “O” of the Glen Elk Bottom Land as the same is laid out and described on the map of said bottom land, and more particularly described as follows: BEGINNING at a point on the north side of Pennsylvania Avenue, 100 feet west of Spring Street and running thence with the north side of said Avenue, in a direction nearly west 50 feet, which is the frontage of said lot on said Avenue; thence back by parallel lines in a direction nearly north at right angles to said Avenue, 150 feet to an alley, 15 feet wide, and fronting 50 feet on said alley. PARCEL NO. 3: BEING all of Lot No. 27, in Block “O” of the Bottom Land of said Glen Elk, as described on the map of said bottom land, more particularly described as follows: BEGINNING at a point on the north side of Pennsylvania Avenue, 50 west of Spring Street and running with the line of Pennsylvania Avenue, in a westerly direction 50 feet to the common corner of Lots 26 and 27, thence with the common line of Lot 26 in a northerly direction 250 feet to the southerly line of a fifteen foot alley, thence running with the line of said alley in an easterly direction 50 feet, thence in a southerly direction 150 feet to Pennsylvania Avenue; thence running with the line of Pennsylvania Avenue in a westerly direction 50 feet to the place of beginning. PARCEL NO. 4: BEING all of Lot No. 28 in Block “O” of the Bottom Land as laid out on the map of said Glen Elk and being located and situate at the corner of Pennsylvania Avenue and Spring Street, fronting 50 feet on said Avenue and running back 150 feet on said Spring Street. BEING the same real estate conveyed unto CG&H, Limited Liability Company by deed dated December 19, 2011, from International Union of Painters and Allied Trades District Council 53, of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2808, at page 228. This conveyance will also be made subject to any and all reservations, exceptions, restrictions, rights of way and easements contained in prior deeds affecting said property of record in said Clerk’s office or visible on the ground. This property will be conveyed by Substitute Trustee together with the hereditaments thereof and all building, structures and improvements now or hereafter situate thereon and all fixtures, materials, supplies, equipment, machinery and other property as is now or may hereafter be an accession thereto, be a fixture thereto, or be otherwise treated or deemed as a part of the land described herein, all of which is included in the term “property” as used herein. By way of example and not by way of limitation, such fixtures and accessions shall include heating, cooling and air-conditioning units, plumbing and electrical fixtures and equipment, built-in appliances of every kind, boilers, machinery, motors, wall-to-wall carpeting, storm doors and windows, awnings and all furnishings attached to the property. The above-described real estate will be conveyed by the undersigned Substitute Trustee to the purchaser by deed containing a Covenant of Special Warranty and subject to all liens, reservations and exceptions appearing in the record of title, and to the lien of all unpaid taxes, if any, which are entitled to priority over the lien of the aforesaid deed of trust. Purchaser must pay all transfer taxes, delinquent or current real estate taxes, title search and any costs related to recording of any Deed from the Substitute Trustee herein. TERMS OF SALE Any successful bidder shall pay 10% of the sales price as a deposit in Certified Funds or Cash at the time of sale with the balance to be paid within 30 days from date of sale. The above-described real estate will be sold by the undersigned Substitute Trustee by auction to the highest bidder subject to the right of the Substitute Trustee to reject all bids if in his opinion they are inadequate. The owner of the indebtedness secured by the above-described deeds of trust and the owner of any other interest in the properties to be sold shall have the right to bid. CONTINUANCE OR ADJOURNMENT OF SALE The Substitute Trustee reserves the right to continue the sale, or adjourn the sale for a time, or from time to time, and the place of sale, as hereinabove set forth, or any continuance or adjournment thereof.
