NOTICE OF SALE BY SUBSTITUTE TRUSTEE UNDER TRUST DEED Notice is hereby given that the undersigned, Stephen P. Swisher, Substitute Trustee, under that certain Deed of Trust executed by WILLARD F. SEXTON, JR., to Jeremiah F. McCormick, Trustee, to secure Larry Slavens, dated December 3, 2014, and duly of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book 4070, at page 510; the said Stephen P. Swisher having been appointed Substitute Trustee, by that Appointment of Substitute Trustee Agreement dated March 27, 2020, and duly of record in the aforesaid Clerk’s Office in Trust Deed Book 4417 at page 935. The maker of the note and obligation described in that Deed of Trust having failed to pay the same as provided for under the terms of the same note and Deed of Trust, and the holder of the note having declared the whole to be due and payable, and having instructed the undersigned Substitute Trustee in writing to make sale of the real estate described in the same deed of trust referenced above, the undersigned Substitute Trustee will sell at public auction for cash to the highest bidder on Tuesday, June 9th, 2020 at 11:00 a.m., at the front door of the Courthouse of Kanawha County, West Virginia, on Virginia Street, in Charleston, West Virginia, all that certain real estate with all tenements, hereditaments and appurtenances thereunto belonging, or in any wise appertaining, and all improvements thereon being situate in Jefferson District, Kanawha County, West Virginia and being known and designated as all of Lots Twenty-Nine (29) and Thirty (30) of Valley View Acres Addition to St. Albans, which map is of record in said Clerk’s Office in Map Book 12 at page 50. Being the same real estate conveyed unto Willard F. Sexton, Jr. by Larry Slavens on December 1, 2014 and being of record in the Office of the Clerk of Kanawha County in Deed Book 2890 at Page 182. FEDERAL TAX LIEN. In the event that there are federal tax liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of said such sale or the period allowed for redemption under law, whichever is longer. This sale is subject to any special assessments, unpaid taxes, liens for unpaid taxes, conditions, reservations, easements, restrictions and covenants affecting the real estate as such exist and may appear from any and all instruments that comprise the chain of title of the real estate. The undersigned Substitute Trustee reserves the right to reject any and all bids. Any successful bidder shall be required to deposit with the Substitute Trustee on the date of sale a deposit of not less than ten percent (10%) of the successful bid price by certified funds or appropriate letter of credit issued by a recognized lending institution. Any successful purchaser of the aforesaid real estate shall take the same in its current condition and the Substitute Trustee herein and the secured parties herein make no warranties whatsoever relative to the physical condition of any improvements situate on the aforesaid real estate. The Substitute Trustee herein reserves the right to continue and/or adjourn the sale advertised hereunder by public proclamation to a time and date deemed appropriate by the undersigned Substitute Trustee.
