UNKNOWN TRUSTEES OF WOODWARD WOODS MISSION, and GAVIN MILLS, TIFFANY BRASHEAR, AND DIANA MILLS, TRUSTEES FOR THE PENTECOSTAL AFFIRMING MINISTRIES, a religious organization, Respondents. ORDER OF PUBLICATION The object of the above-styled action is to acquire a 10-foot wide permanent easement and a 15-foot wide related temporary easement in Respondents’ real property by eminent domain. Petitioner has determined that acquisition of the real property interest is necessary to accomplish the purposes of constructing and improving the City of Charleston’s sanitary sewer system, therefore maintaining adequate and reliable sewer service, in the Woodward Branch area (“Woodward Branch Project”). Specifically, a 10-foot wide permanent easement is necessary to construct, install, operate, maintain, repair, replace, rehabilitate, line, and remove a sewer line for use as part of Petitioner’s sewer system in, on and under Respondents’ real property and the 15-foot wide temporary easement is necessary for the initial construction and installation of the sewer line. In order to accomplish the Woodward Branch Project, Petitioner must appropriate, acquire and use a permanent easement and temporary easement in, on, across and over the Respondents’ real property designated as Parcel 63 of Tax Map CN 82 of the Charleston North Tax District, City of Charleston, Kanawha County, West Virginia, more particularly described in the Petition previously filed in this civil action. If Respondents claim an interest in the real estate described in the above-styled action, they or any of them must serve upon Susan J. Riggs and Gerald M. Titus, III at 300 Kanawha Boulevard, East, Charleston, West Virginia 25301, an answer or other defense or statement of interest in the subject real property to the Petition filed in the above-captioned civil action on or before June 25, 2020, otherwise judgment by default will be taken against one or more of the unknown Trustees of Woodward Woods Mission at any time thereafter.
