NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated June 27, 2016, executed by Borrower, Stephen Douglas Shattuck, to Vance Golden, Attorney, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 4179, at Page 21. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 313 Ehman Dr, Charleston, WV 25302. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated April 27, 2020, of record in the Clerk’s Office in Book 4421, Page 375. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 18th day of June, 2020 at 10:00 a.m. PARCEL ONE: The surface only of all that certain lot or parcel of real estate situate in Elk District, Kanawha County, West Virginia, and being parts of Lots Three (3) and Four (4) of Sub-Section “A” in Section “B” of Knollwood Addition, Elk District, Kanawha County, West Virginia, and more particularly bounded and described as follows: Beginning at a point in the southerly line of Ehman Drive, said point being a corner common to Lots 3 and 4, being the northwesterly corner of Lot 4 and northeasterly corner of Lot 3; thence along the southerly line of Ehman Drive S. 74 09′ E. 60 feet to a corner common to Lots 4 and 22; thence along the line of Lot 22 in part and in part along the line of Lot 5, S. 26 14′ W. 207.2 feet to a corner common to Lots 4 and 5 in the northerly line of Ehman Drive, thence along said northerly line of Ehman Drive N. 37 52′ W. 74.6 feet to a corner common to Lots 3 and 4; thence running within the bounds of Lot 3 N. 24 05′ E. 81.5 feet to a point; thence S. 65 57′ E. crossing the common line between Lots 3 and 4, 14.0 feet to a point within Lot 4; thence N. 24 03′ E. 81.0 feet to the point and place of beginning, and being the same parcel of real estate shown on a map dated June 23, 1964, prepared by J. Lewis Hark, Professional Engineer, and entitled “No. 313 Ehman Drive, being Part of Lots 3 and 4 of Section ‘B’, Subsection ‘A’ Knollwood, an Addition near the City of Charleston, Elk District, Kanawha County, West Virginia”. This conveyance is made subject to those restrictions in Deed dated November 15, 1960, and recorded in the aforesaid Clerk’s Office in Deed Book 1324, at Page 43, and further subject to that certain easement granted unto Appalachian Electric Power Company by instrument dated May 09, 1945, and recorded in Deed Book 703, at Page 157, and subject further to those certain easements granted unto the C & P Telephone Company of West Virginia, by instruments dated February 25, 1955 and January 20, 1956, and recorded Deed Book 1127, at Page 454 and Deed Book 1163, at Page 313 respectively. PARCEL TWO: The surface only of that certain lot or parcel of land, situate in Elk District, Kanawha County, West Virginia, and being all of Lot No. Twenty-two (22) of Sub-Section A in Section B of Knollwood Addition, as shown and designated upon that certain map entitled “Map of Section ‘B’ Sub-Sections A-B-C-D, Knollwood Addition, Elk District, Kanawha County, West Virginia”, dated May 14, 1953, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Map Book 18, at Pages 46 and 47. This conveyance is subject to the same covenants, conditions, restrictions, and limitations as are recited and contained in the Deed from Laura Ehman Conner and H. G. Conner, her husband, to Earl L. Vaughn and Jerry A. Legg, dated November 15, 1960, and recorded in aforesaid Clerk’s Office in Deed Book 1324, at Page 43. Legal description for PARCEL ONE as described in Deed to Wilbur C. West and Betty M. West, recorded August 21, 1967, in Book 1499, Page 325: Being the same property conveyed to Stephen Douglas Shattuck by the Deed dated June 9, 2016 and recorded in Deed Book 2944 at Page 397 in the Office of the Clerk of the County Commission of Kanawha County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
