NOTICE OF TRUSTEE SALE Pursuant to the authority vested by Deed of Trust dated the 7th day of May, 2014, Gregg L. Lowe, aka Gregory L. Lowe, aka Gregg Lowe, Grantor, to P. Andrew Vallandingham and Samuel Vallandingham, Trustees, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2529 beginning at page 331, and the undersigned, Daniel T Yon and Ralph J. Hagy, substituted Trustees, by Substitution of Trustees of record in the office of the Clerk of the County Commission of Cabell County in Trust Deed Book 403 at page 487 having been requested to do so by the Lender, and default having been made under the terms and conditions of said Deed of Trust, and the provisions of said Deed of Trust concerning acceleration having been complied with by the Lender and present holder of the note, said substituted Trustees shall sell at public auction on June 24, 2020 at 11:00 a.m. at the front steps of the courthouse of Cabell County, West Virginia, the following real estate more particularly described as follows: All that certain lot, piece or parcel of land situate in the City of Huntington, Cabell County, West Virginia, known and designated on a map of Fairview Plan of Lots, a copy of which map was recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, on May 2, 1906, in Deed Book 83, at page 435, and thereon designated as Lot Number Nineteen (19) and the westerly one half (1/2) of Lot Number Eighteen (18), in Block “A”, and being more particularly described as follows: BEGINNING at a point in the south line of West 5th Avenue (formerly Champion Avenue) at the corner between Lots 19 and 20, as shown on said map; thence with the said line of West 5th Avenue, easterly 45 feet; thence southerly and parallel to the said line between Lots 19 and 20, 105 feet to a point in the north line of a 10 foot alley; thence westerly with said alley line 45 feet to a point in the line between said Lot 19 and Lot 20, thence with said line northerly 105 feet to the beginning. TERMS OF SALE: Ten percent (10%) of total bid amount cash in hand on day of sale. Remainder due within 30 days from date of Trustee Sale. Payment for unpaid real estate taxes to be assumed by the purchaser. Subject to any and all assessments and taxes against said property, and all prior liens and encumbrances of any nature whatsoever. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 2 of Chapter 11 of the West Virginia Code. Any sale hereunder may be adjourned from time to time without any notice other than the oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Subject to the right of the Internal Revenue Service to redeem the property as provided by Section 7425 of the Internal Revenue Code, as amended. The undersigned is fully vested with the authority to sell said property as substituted Trustee. Any required inspections must be completed prior to bidding. Property is being sold as is.
