NOTICE OF SUCCESSOR TRUSTEE’S SALE Notice is hereby given that by virtue of the following deed of trust 1. Deed of Trust dated the 4th day of October, 2005, made by Roger L. Shafer and Paula D. Shafer, husband and wife, to W. Stephen Flesher, Trustee, for the benefit of The Ohio Valley Banking Company, an Ohio corporation (“Ohio Valley Bank”), of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book No. 3293, at Page 841. Default having been made in the payment of the indebtedness secured thereby, and the undersigned, Thomas H. Gilpin, Successor Trustee, having been appointed as the Successor Trustee under said deed of trust by instrument dated May 6, 2020 and recorded in the aforesaid Clerk’s Office in Trust Deed Book No. 4424, at Page 669, and having been required to do so by Ohio Valley Bank, the owner and holder of the obligations secured by said deed of trust, and having full and absolute power and authority in the premises, will on the 30th day of June, 2020, at 10:00 a.m. Eastern Time, offer for sale and sell at public auction with the assistance of an auctioneer, for cash to the highest bidder under the terms described herein, at 49 Upper Pinch Road, Elkview, Kanawha County, West Virginia (being the location of the subject property), the following described property situated and being in the County of Kanawha, State of West Virginia, being surface only and described as follows: All of that certain parcel of land, together with all appurtenances thereto belonging, situate of the waters of Pinch Creek, Elk District, Kanawha County, West Virginia, and being more particularly described as follows: BEGINNING at a chiseled mark in a concrete driveway, said chiseled mark being in the right-of-way of West Virginia County Route 52/2 and also being a corner of the land of Power Plant Service, Inc. and upper Pinch Estates Subdivision; thence the right-of-way said Route 52/2 S. 81 3′ 1″ W., a distance of 62.46 feet to a six inch steel pipe, said six inch steel pipe being in the right-of-way of said Route 52/2 and also being a corner of said Power Plant Service, Inc. Property and I. Cummings property; thence leaving right-of-way of said West Virginia County Route 52/2 and with the property line of said Power Plant Service, Inc. And said Cummings the following three courses and distances: 1. N. 27 42′ 16″ W., a distance of 56.30 feet to an iron pin; 2. N. 43 41′ 58″ W., a distance of 124.30 feet to an iron pin; 3. N. 65 43′ 36″ W., a distance of 73.96 feet to an iron pin, said iron pin being a corner of said Power Plant Service, Inc., said Cummings and another tract belonging to said Power Plant Service, Inc.; thence with this property line of said other Power Plant Service, Inc. tract, N. 2 23′ 21″ E., a distance of 379.43 feet to a one-half inch rebar with yellow cap, said rebar being a new corner in the property line of said Power Plant Service, Inc., also being a corner of Lot No. 1 and Lot No. 2 of this survey; thence with a new division line along and through the land of said Power Plant Service, Inc., also being the division line of said Lot No. 1 and Lot No. 2, N. 89 45′ 18″ W., a distance of 342.90 feet to a one-half inch rebar with plastic cap, said rebar being a corner of said Lot No. 1 and Lot No. 2 of this survey and also being in the property line of said Power Plant Service, Inc. other tract; thence with the property line of said Power Plant Service, Inc. Other tract the following four courses and distances: 1. S. 3 50′ 57″ W., a distance of 114.45 feet to a point; 2. S. 11 45′ 33″ W., a distance of 85.28 feet to a point; 3. S. 13 8′ 58″ W., a distance of 154.77 feet to a point; 4. S. 14 45′ 18″ W., a distance of 150.00 feet to a one-half inch rebar with plastic cap, said rebar being a corner of said Power Plant Service, Inc. and said upper Pinch Estates Subdivision; thence with the property line of said Power Plant Service, Inc. and upper Pinch Estates Subdivision, S. 21 53′ 57″ W., a distance of 51.20 feet to the place of beginning containing 3.42 acres be it the same more or less and as shown as Lot No. 1 on a plat of survey by Dunn Engineers, Inc. of Charleston, West Virginia, said plat dated February 10, 1988, which is attached to that certain deed dated August 22, 1989 from Power Plant Service, Inc. to Roger L. Shafer and Paula D. Shafer, his wife, which is recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book No. 2232, at Page 63 and being the same deed pursuant to which such property was conveyed to Roger L. Shafer and Paula D. Shafer. TERMS OF SALE: 1. Cash in hand paid on the date of sale, or at the option of the successful bidder, execution of Successor Trustee’s form of memorandum of sale requiring, among other things, ten percent (10%) of the amount of the “accepted bid” paid in cash on the date of sale with the balance being payable within 30 days of the date of the sale. There will be added to any bid a “buyer’s premium” equal to ten percent (10%) of any bid so the amount of an “accepted bid” shall be the sum of the bid plus the buyer’s premium. 2. Subject to any and all assessments and taxes against said property, and all matters of record in the aforesaid Clerk’s Office senior in priority to the deed of trust under which this sale is being made, including without limitation all prior liens and encumbrances of any nature whatsoever. 3. Subject to the liens for ad valorem real estate taxes for the tax years 2019 and 2020. 4. The Successor Trustee reserves the right to adjourn the sale, for any time, or from time to time, without further notice by announcement at the time and place of sale described above or any adjournment thereof. 5.
