NOTICE OF TRUSTEE SALE Pursuant to the authority vested by Deed of Trust dated the 14th day of March, 2013, Blue Surf, LLC, Grantor, to P. Andrew Vallandingham and Samuel Vallandingham, Trustees, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2476 beginning at page 359, and the undersigned, Daniel T Yon and Ralph J. Hagy, substituted Trustees, by Substitution of Trustees of record in the office of the Clerk of the County Commission of Cabell County in Trust Deed Book 404 at page 167 having been requested to do so by the Lender, and default having been made under the terms and conditions of said Deed of Trust, and the provisions of said Deed of Trust concerning acceleration having been complied with by the Lender and present holder of the note, said substituted Trustees shall sell at public auction on June 24, 2020 at 12:20 p.m. at the front steps of the courthouse of Cabell County, West Virginia, the following real estate more particularly described as follows: All that certain lot, tract or parcel of land, together with the improvements thereon and the appurtenances hereunto belonging, situate in the City of Huntington, Cabell County, West Virginia, known and designated on a map of Subdivision of John Trenear Estate, a copy of which is of record in the Cabell County Court Clerk’s Office in Deed Book 121, at page 106, as a cross-sectional part of Lots Nos. 5 and 6, Block No. 61, and being more particularly described as follows: Beginning at a point in the east line of Eleventh Street West, which point is southerly 77 feet from the point of intersection of the said line of Eleventh Street West with the south line of Madison Avenue, thence with the said line of Eleventh Street, West, southerly 38 feet; thence easterly and parallel to the said line of Madison Avenue, 80 feet; thence northerly and parallel to the said line of Eleventh Street West, 38 feet; thence westerly and parallel to the said line of Madison Avenue, 80 feet to the point of beginning. TERMS OF SALE: Ten percent (10%) of total bid amount cash in hand on day of sale. Remainder due within 30 days from date of Trustee Sale. Payment for unpaid real estate taxes to be assumed by the purchaser. Subject to any and all assessments and taxes against said property, and all prior liens and encumbrances of any nature whatsoever. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 2 of Chapter 11 of the West Virginia Code. Any sale hereunder may be adjourned from time to time without any notice other than the oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Subject to the right of the Internal Revenue Service to redeem the property as provided by Section 7425 of the Internal Revenue Code, as amended. The undersigned is fully vested with the authority to sell said property as substituted Trustee. Any required inspections must be completed prior to bidding. Property is being sold as is.
