Caudill 2337 Cannonsburg Rd Catlettsburg, KY 41129 NOTICE OF SALE Under authority of a certain A Deed of Trust dated January 18, 2002, from Romie M. Samples and Greta J. Samples to Wayne King and J.D. Morris, Trustees, securing Clay County Bank in the amount of $160,000.00, of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 2794, at page 706, default having been made in the payment of the obligation secured by said Deed of Trust, and sale having been requested in writing by the holder of the indebtedness secured, the undersigned, Raymond G. Dodson, Substitute Trustee, by virtue of Notice of Substitution of Trustee dated May 27, 2020, and recorded in the aforesaid Clerk’s Office in Trust Deed Book 4426 at page 281, will offer for sale at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on July 16, 2020, at 11:00 o’clock, the certain real estate conveyed in said Deed of Trust, more commonly known as 405 and 407 Jarvis Street, Charleston, WV 25302, which is further bounded and described as follows: All those certain tracts or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Elk District, in Kanawha County, West Virginia, and further bounded and described as follows: TRACT NO. ONE: BEGINNING at an iron pipe in the westerly line of a 30 foot road known as “Derrick Drive”, said iron pipe being located N. 8-15 E., 150 feet from the intersection of the westerly line of Derrick Drive and the northerly line of U.S. Route 119; thence leaving the westerly line of Derrick Drive and running N. 86-45′ W., a distance of 150 feet to an iron pipe; thence running N. 8-15′ E., 60 feet to an iron pipe; thence running S. 86-45′ E., a distance of 150 feet to an iron pipe in the westerly line of Derrick Drive; thence running to an iron pipe in the westerly line of Derrick Drive S. 8-15′ W., 60 feet to the place of beginning. BEING the same property described in that certain survivorship deed unto Romie M. Samples and Greta J. Samples, of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2324, at page 803. TRACT NO. TWO: BEGINNING at an iron pipe on the east side of Jarvis Street being the southwest corner of the Ezra Burdette lot; thence with the line of the Burdette lot S. 76-33′ E., 25.37 feet to an iron pin; thence N. 87-23′ E., 76.52 feet to an iron pin, the southwest corner of the Burdette lot; thence N. 87-23′ E., 108.85 feet to an iron pin in the line of the C.W. Crede Subdivision; thence with the line of said subdivision S. 14-30′ W., 120.80 feet to an iron pin; thence N. 87-35′ W. 216.05 feet to an iron pin in the east line of Jarvis Street thence with the line of Jarvis Street N. 9-45′ E., 77.17 feet to a ten (10) inch black walnut; thence N. 38-19′ E., 37.27 feet to the southwest corner of the Burdette lot, the place of beginning, all as shown upon a map attached to a Deed dated September 20, 1976, to Romie R. Samples and Greta J. Samples, his wife, which map was made by D.K. Carr, R.P.C.E. #4568 dated September 11, 1976, entitled “Survey of Ralph Derrick Property Located on U.S. Route #119, Approx. 4.2 Miles North East of The City Limits Of Charleston, Elk District, Kanawha County, W.Va.”. BEING the same property described in that certain survivorship deed dated September 20, 19176, from Ralph H. Derrick and Edith E. Derrick to Romie M. Samples and Greta J. Samples, of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 1807, at page 92. The said Greta J. Samples predeceased Romie M. Samples and pursuant to the survivorship provisions contained in said deeds, Romie M. Samples became the sole owner thereof. The said Romie M. Samples died on or about October 9, 2019, with his heirs being Romie Robert Samples, II, son and Diana S. Caudill, daughter. This conveyance will also be made subject to any and all reservations, exceptions, restrictions, rights of way and easements contained in prior deeds affecting said property of record in said Clerk’s office or visible on the ground. This property will be conveyed by Substitute Trustee together with the hereditaments thereof and all building, structures and improvements now or hereafter situate thereon and all fixtures, materials, supplies, equipment, machinery and other property as is now or may hereafter be an accession thereto, be a fixture thereto, or be otherwise treated or deemed as a part of the land described herein, all of which is included in the term “property” as used herein. By way of example and not by way of limitation, such fixtures and accessions shall include heating, cooling and air-conditioning units, plumbing and electrical fixtures and equipment, built-in appliances of every kind, boilers, machinery, motors, wall-to-wall carpeting, storm doors and windows, awnings and all furnishings attached to the property. The above-described real estate will be conveyed by the undersigned Substitute Trustee to the purchaser by deed containing a Covenant of Special Warranty and subject to all liens, reservations and exceptions appearing in the record of title, and to the lien of all unpaid taxes, if any, which are entitled to priority over the lien of the aforesaid deed of trust. Purchaser must pay all transfer taxes, delinquent or current real estate taxes, title search and any costs related to recording of any Deed from the Substitute Trustee herein. TERMS OF SALE Any successful bidder shall pay 10% of the sales price as a deposit in Certified Funds or Cash at the time of sale with the balance to be paid within 30 days from date of sale. The above-described real estate will be sold by the undersigned Substitute Trustee by auction to the highest bidder subject to the right of the Substitute Trustee to reject all bids if in his opinion they are inadequate. The owner of the indebtedness secured by the above-described deeds of trust and the owner of any other interest in the properties to be sold shall have the right to bid. CONTINUANCE OR ADJOURNMENT OF SALE The Substitute Trustee reserves the right to continue the sale, or adjourn the sale for a time, or from time to time, and the place of sale, as hereinabove set forth, or any continuance or adjournment thereof.
