Crum, Unknown Persons/Owners, and Randall White, Sheriff of Boone County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”) that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Boone County, West Virginia, and is known as Civil Action No. 20-P-50, and styled Appalachian Power Company vs. Danny J. Crum, et al. Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate on the waters of the Spruce Fork of Little Coal River, in Washington District, Boone County, West Virginia, and identified as Tax Map 26D, Parcel 47, and recorded in Deed Book No. 212, at page 667, in the office of the Clerk of the County Commission of Boone County, West Virginia, and bounded and described as follows: 2.3 SF., SPRUCE FK BEGINNING at a steel pipe located in the southern right of way line of a 20 ft. roadway, or outlet road, through lands of Cora A. Ball (in 1955), which road provides an outlet from the cemetery to the public highway; thence S. 11 degrees 32 E. 725 ft. to a steel pipe corner; thence S. 68 degrees 21 40 E. 90 feet to an 8 locust; thence S. 12 degrees 01 20 E. 395 feet to a steel pin driven in the ground near a black jack tree; thence up the point 200 feet, more or less, to a black jack tree; thence in a northeasternly direction 1320 feet, more or less, passing through a steel peg driven in the ground approximately 320 feet, more or less, from the black jack tree and passing through a red maple located approximately 350 feet, more or less, below the steel peg to a steel peg driven in the ground in the line of a twenty (20) foot alley or outlet road, said corner being also the line of the Charles Perry land; thence with the said 20 foot alley in a southwesternly direction 128 feet to the place of beginning, containing 2.3 acres, more or less. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Boone County Circuit Clerk’s office at 200 State Street, Madison, West Virginia, 25130, for the purposes of appearing and defending. The Petition for Condemnation/Right of Entry may also be obtained from the attorneys for Appalachian Power Company, Stephen F. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation/Right of Entry will occur on July 9, 2020, at 2:00 p.m., in the Circuit Court of Boone County, West Virginia, located at 200 State Street, Madison, West Virginia, 25130, before the Honorable William S. Thompson. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
