TO: RESPONDENTS, 3AJ, LLC, TCP BRIGHT, LLC, UNKNOWN PERSONS/ OWNERS, AND GARY LINVILLE, SHERIFF OF LINCOLN COUNTY, WEST VIRGINIA Notice is hereby given to 3AJ, LLC, TCP Bright, LLC, Unknown Persons/ Owners, and Gary Linville, Sheriff of Lincoln County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”) that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Lincoln County, West Virginia, and is known as Civil Action No. 20-C-17, and styled Appalachian Power Company vs. 3AJ, LLC, et al. Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate in Laurel Hill District, Lincoln County, West Virginia, and identified as Tax Map 6, Parcel 43, and recorded in Deed Book No. 405, at page 254, in the office of the Clerk of the County Commission of Lincoln County, West Virginia, and bounded and described as follows: SUR & TIMBER 300 ACRES 10 MILE FIRST TRACT: BEGINNING at the corner of the lands of Wandell Courts’ land at a white oak tree; thence running in a N.W. direction to another white oak; thence continuing in the same direction a distance of 199 feet to a white oak on tip of point; thence following the center of the ridge 384 feet to a white oak on ridge, thence continuing with the center of the ridge in the same direction of 693 feet to a white oak on ridge; thence around the ridge a distance of 202 feet to a white oak on ridge; thence 464 feet to a white oak on ridge; thence 412 feet to a hickory on the ridge, a corner of Garnet Adkins’ line; thence running West 90 feet to a cucumber tree, a corner of Garnet Adkins’ line; thence binding on the line of Garnet Adkins, (formerly the land of Mike Adkins); thence continuing with the same calls and distances as set forth in a deed from Ralph and Mary Jarrell, Husband and wife, to Barney Sanders, dated February 17, 1958, from said cucumber to the land of Letha Hager, as shown in said deed; thence running with the Letha Hager line, N. 0 30′ E. 473 feet to a stake in a flat by the haul road at the call of a hickory (gone) said stake bears S. 65-1/4 E. 36 feet to a beech witness; thence running in a southerly direction a distance of approximately 200 feet to Buck Branch, and the line of Wandell Courts land; then running with and binding on his line to the beginning corner, containing 300 acres, more or less. Together with a right-of-way 12 feet in width over a tract of 15 acres, deeded to Eugene Huffman and Lena White, be deed dated September 24, 1975. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Lincoln County Circuit Clerk’s office at 8000 Court Avenue, Hamlin, West Virginia, 25523, for the purposes of appearing and defending. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation/Right of Entry will occur on July 17, 2020, at 10:15 a.m., in the Circuit Court of Lincoln County, West Virginia, located at 8000 Court Avenue, Hamlin, West Virginia, 25523, before the Honorable Jay M.
