TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated September 23, 2005, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed of Trust Book 3289, at Page 153, Kip A. Barker did convey unto Richard A. Pill, Trustee, certain real property described in said Deed of Trust; and default having been made under the aforementioned Deed of Trust, and the undersigned Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse, in Charleston, West Virginia, on July 14, 2020, at 5:40 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Union District, Kanawha County, West Virginia, and more particularly described as follows: All that certain lot, tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Union District, Kanawha County, West Virginia, and being all of Lot No. Eight (8) of Section One of Elmhaven Estates, as designated and shown upon a map thereof entitled “Subdivision Map of Section No. One Elmhaven Estates Developed by: Robert S. Young, Jr. Situated on the Waters of Rocky Fork Creek near Cross Lanes Union District, Kanawha County, W. Va.”, made by Wilkinson Surveying and Engineering, Incorporated, bearing date March 12, 1979, and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Photostatic Map Book 31 at Page 25. Along with the right to use all streets and easements extending across the property known as Elmhaven Estates, situate in said Union District, Kanawha County, West Virginia, for the purpose of ingress and egress to and from the property herein conveyed and the county road, along with the right to use the sewer lines and all utility lines in said subdivision. SUBJECT TO the reservation by Hollee Construction Company, a corporation, of the right to change or relocate the streets and roads in said subdivision as provided in the Declaration of Protective Covenants hereinafter described, as long as such changes do not in any way interfere with the use of L. G. & D. Homes, Inc., a corporation, its successors and or assigns, to use said streets and rights of way and free access to the same, as set forth in Deed dated October 28, 1980, and recorded in the aforesaid Clerk’s Office in Deed Book 1959, at Page 678. SUBJECT TO those certain covenants, restrictions and reservations as are set forth in that certain Declaration of Protective Covenants, bearing date April 12, 1979, and of record in the aforesaid Clerk’s Office in Deed Book 1902, at Page 337. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 5007 Elm Haven Circle, Cross Lanes, WV 25313. AND BEING the same real estate which was conveyed to Kip A. Barker, by deed dated September 13, 2005, from Russell S. Daugherty and Heather R. Morgan, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book, 2642 at Page 871. The above described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
