TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated May 20, 2009, and duly recorded in the Office of the Clerk of the County Commission of Lincoln County, West Virginia, in Document No. 2009003997, in Book No. 00212, at Page 00601, Jeffrey M Harbour and Angie L Harbour did convey unto Sara B. Lopez, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated July 15, 2016 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Carrington Mortgage Services, LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Lincoln County Courthouse in Hamlin, West Virginia, on July 22, 2020 at 1:00 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Duval District, Lincoln County, West Virginia, and more particularly described as follows: All that certain tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate on the waters of Donley Fork of Hazelette Fork of Trace Fork of Mud River and at the intersection of West Virginia Secondary Route 9/5 and 14/5, approximately 2.7 miles north of Sod, in Duval District, Lincoln County, West Virginia, and being more particularly bounded and described as follows: BEGINNING at a point situate in the northeast corner of the real estate herein conveyed, said point being further located in the common division line between the real estate herein conveyed and that certain parcel of real estate now or formerly owned by Richard Belcher as described by that deed of record in the Office of the Clerk of the County Commission of Lincoln County, West Virginia, in Deed Book 185 at page 44; thence S. 07 08′ W. passing an iron pin at 35.64 feet located in the northerly right of way line of West Virginia Secondary Route 14/5, a total distance of 357.52 feet to an iron pin; thence S. 79 27′ W. 469.56 feet to an iron pin situate in the easterly line of West Virginia Secondary Route 9/5; thence running with the easterly line of West Virginia Secondary Route 9/5, N. 03 53′ E. 217.20 feet to a point; thence N. 11 37′ E. 125.00 feet to a point; thence N. 14 53′ E. 137.60 (erroneously referred to as thence N. W. 53′ E. 137.60) feet to a point; thence N. 43 15′ E. 126.30 feet to a point; thence N. 78 32′ E. 30.80 feet to a point; thence S. 78 22′ E. 149.30 feet to a point; thence S. 65 08′ E. 106.00 feet to a point; thence S. 48 02′ E. 46.70 feet to a point; thence S. 57 20′ E. 43.80 feet to the place of beginning, containing 5.0 acres, and being the same real estate set forth and designated as Parcel 1 upon that certain map entitled, “Plat of Survey Showing Parcels 1, 2 and 3 of the George and Melissa Stafford Farm Situate on Donley Fork of Hayzlett Fork of Trace Fork of Mud River, in Duval District, Lincoln County, West Virginia”, said map dated October 20, 1994, made by Eagle Surveying, Inc., a copy of said map being of record in said Clerk’s Office. And being part of the same real estate conveyed unto Angie L. Harbour and Jeffrey M. Harbour by Mark Edwin Byrd and Tamrny Denise Byrd, by Deed dated July 27,2007 and of record in the aforesaid Clerk’s Office in Deed Book 319 at page 378. Also including 1995 Skyline Serial No. 14391236HAB. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 300 Donley Fork Road, Sod, WV 25564. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
