TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated March 26, 2015, and duly recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Document No. 575246, in Book No. 2568, at Page 288, Everett J Hutchinson and Thelma J Hutchinson did convey unto Thomas C. Stewart, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by The Huntington National Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Fourth Avenue Entrance of the Cabell County Courthouse in Huntington, West Virginia, on July 28, 2020 at 12:00 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 09 – City/Milton District, Cabell County, West Virginia, and more particularly described as follows: All that certain parcel of land situate in the City of Milton, County of Cabell and State of West Virginia bounded and described as follows: PARCEL ONE (1) All that certain lot, piece or parcel of land situated in the Town of Milton, Cabell County, West Virginia, known and designated on a map of the Ira J. Harshbarger Addition, Milton, West Virginia, a copy of which map is filed in the Cabell County Clerk’s Office in Map Book 2, as Map 34, as Lot 22 and the westerly 23 feet of Lot 23, Block 5, and being more particularly described as follows: BEGINNING at a point in the north line of Florida Street at the corner between Lots 21 and 22, as shown on said map, said point being distant easterly 218 feet from the point of intersection of the said line of Florida Street with the east line of Smith Street; (hence with the said line of Florida Street, easterly 60 feet, thence northerly, parallel to and 14 feet west of the line between Lots 23 and 24, 130 feet to a point in the south line of a 16 foot alley, thence with said alley line, westerly 60 feet to a point in the line between said Lots 21 and 22, thence with said line, southerly 130 feet to the point of BEGINNING. Cox by S.J. Reynolds, widower, by deed dated the 31st day of August, 1946, and now appearing of record in the office of the Clerk of the County Court of Cabell County, West Virginia, in Deed Book No, 372, at page 4; thence running easterly with the south line of said Lot No, 23, which is the north line of said Florida Street, a distance of 5 feet to a concrete marker set in the ground; thence northerly a straight course and parallel with the west line of said Lot No. 23, 130 feet, more or less to a point in the north line of said Lot No, 23, which is the south line of on east and west alley, marked by a concrete marker set in the ground 28 feet easterly from the northwest corner of said Lot No. 23, and 5 feet easterly from the northeast corner of the west 23 feet of said Lot No, 23 as conveyed to John J. Cox by S. J. Reynolds by the deed hereinbefore mentioned; thence westerly with the north, line of said Lot No. 23, which is the south line or said east and west alley, 5 feet to the northeast corner of the said John J. Harshbarger Addition of Milton, West Virginia, a copy of which map is filed in the office of the Clerk of the County Court of Cabell County, West Virginia, in Map Book 2 at Map 34, as the easterly 9 feet of Lot 23, Block Five, and being more particularly described as follows: BEGINNING at a concrete marker set in the ground at the southeast corner of the live foot strip of land conveyed to the said second party by A.K. Holley and Mary I. Holley, his wife, by deed dated April 12, 1948, recorded in the said Clerk’s office in Deed Book 396 at Page 187, which concrete marker is in the southerly line of said Lot 23, which is the northerly line of Florida Street; thence, easterly with the south line of said lot and the north line of said Florida Street, 9 feet to the southeast corner of said lot 23; thence, northerly, with the east line of said lot 23, 130 feet, more or less, to the north line of said Lot 23 being the south line of an east and west alley; thence, westerly, with said alley line and with the north line of said Lot 23, 9 feet to a concrete marker; and thence, southerly, with the east line of said 5 foot strip of land hereinabove mentioned 130 feet, more or less, to the place of BEGINNING, and containing 1,170 square feet, more or less. Being the same property as transferred by deed dated 06/03/2005, recorded 06/14/2005, from James D. King and Suzane C. King, husband and wife, to Everett J. Hutchinson and Thelma J. Hutchinson, husband and wife, or the survivor, as joint tenants with the incident of survivorship and not as tenants in common, recorded in book 1141, page 187. Tax ID: 09-02-27 At the time of the execution of the Deed of Trust, this property was reported to have an address of: 911 Florida St, Milton, WV 25541. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $4000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale.
