NOTICE CASE NO. 18-1534-PWD-42R LAVALETTE PUBLIC SERVICE DISTRICT, a public utility, Lavalette, Wayne County. Petition seeking reopening of case to eliminate Step-2 rate reduction NOTICE OF FILING W. VA. Code 24-1-1(k) requires water and sewer utilities that are political subdivisions of the state to maintain a working capital reserve in an amount of no less than one-eighth of actual annual operation and maintenance expense. On May 30, 2019, the Public Service Commission of West Virginia (Commission), in Case No. 18-1534-PWD-42R, approved implementation of a cash working capital increment to allow Lavalette Public Service District to generate the required cash working capital reserve over a two-year period. At the end of the two-year period, December 5, 2020, the cash working capital reserve rate increment would cease resulting in a rate reduction of 4.2%. On May 20, 2020, Lavalette Public Service District filed a Petition requesting that the Commission cancel the Step 2 rates approved in Case No. 18-1534-PWD-42R. The Step 2 rates were to go into effect on December 5, 2020. The result of canceling the Step 2 rates would be that the current rates remain in effect instead of a rate reduction of approximately 4.2% on average that would otherwise been effective on December 5, 2020. Anyone desiring to protest should file a written protest as soon as possible, but no later than ten (10) days after the date of publication of this Notice. All written protests should briefly state the reason for the protest. Absent substantial protest the Commission may decide the case on the filings.
