BUSH, CRANBERRY PIPELINE CORPORATION, UNKNOWN PERSONS/OWNERS, AND MICHAEL Y. RUTHERFORD, SHERIFF OF KANAWHA COUNTY, WEST VIRGINIA Notice is hereby given to Christopher S. Bush, Cranberry Pipeline Corporation, Unknown Persons/Owners, and Michael Y. Rutherford, Sheriff of Kanawha County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”) that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Kanawha County, West Virginia, and is known as Civil Action No. 20-P-37, and styled Appalachian Power Company vs. Christopher S. Bush, et al. Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate and being in Washington District, Kanawha County, West Virginia, and identified as Tax Map 10, Parcel 0115, and recorded in Deed Book No. 2523, at page 0798, in the office of the Clerk of the County Commission of Kanawha County, West Virginia, and bounded and described as follows: 25A SUCK FORK ALUM CREEK BEGINNING at a chestnut and Chestnut oak trees on a point, thence with a line of the same, S. 08 W. 119 poles to a chestnut on a hill; thence leaving said survey and running to a black oak on the creek below; thence crossing the creek and running up to a white oak below the Martin Field; thence to the chestnut oak, the place of beginning, containing twenty-five (25) acres, more or less; and being all of the same property which was conveyed to Collett D. Fields and Lola M. Fields, his wife, by Gertrude Parsons Dew, by deed dated January 10, 1967 and of record in Deed Book 1482 at page 663. Reference to the aforesaid deed is hereby made for a more particular description of the property hereby conveyed and for all other pertinent purposes. Said right of way being located along the easterly line of the Darrell Fields tract recorded in the aforesaid Clerk’s Office in Deed Book 1959 page 45 for which centerline of said right of way being further described as follows: Beginning at a point in the southerly line of said Crooked Creek Road, WV Route 9/4 and from which a 1/2 inch rebar set at the northwest corner of the 5.83 acre tract described above bears, N. 72 degrees 54′ E. 87.76 feet; thence with the said centerline of said right of way and being 15.00 foot east of and parallel to the said Darrell Fields tract, S. 44 degrees 25′ E. 254.46 feet to a point being the terminus of said right of way and being S. 24 degrees E. 227.94 feet from the said 1/2 inch rebar being the northwest corner of the above described 5.83 acre tract, all as shown on the above described map. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Kanawha County Circuit Clerk’s office at 111 Court Street, Charleston, West Virginia, 25301, for the purposes of appearing and defending. The Petition for Condemnation/Right of Entry may also be obtained from the attorneys for Appalachian Power Company, Stephen F. Gandee, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation/Right of Entry will occur on September 3, 2020, at 2:00 p.m., in the Circuit Court of Kanawha County, West Virginia, located at 111 Court Street, Charleston, West Virginia, 25301, before the Honorable Louis H. “Duke” Bloom. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
