Karr, Jr., counsel for the plaintiff, NR Deed, LLC, requested, based upon the affidavit of due diligence executed by Robert MacDonald, an order of publication be entered relating to providing notice of the pendency of this proceeding to Robert E. Jones c/o and/or dba A Personal Services. In the complaint in this matter, the plaintiff seeks a judgment for damages incurred by the plaintiff as a result of a breach of contract and fraud accomplished upon the plaintiff by the defendant arising generally from the relationship between the parties as generally memorialized in said written contract. The plaintiff seeks contractual damages, special fraud damages, general fraud damages and punitive damages. It appears to the plaintiff and to the undersigned, his counsel, that the defendant, Robert E. Jones, is now likely a non-resident of Kanawha County and now is likely a non-resident of the State of West Virginia. The Court FINDS that the plaintiff has attempted with due diligence and without success to cause the defendant to be personally served. It is hereby ORDERED that Robert E. Jones, doing business as A Personal Services, serve upon David R. Karr, Jr., whose address is Post Office Box 1283, Charleston, WV 25325-1283, an Answer, including any related counterclaim or defense you may have to the Complaint filed in this action before August 15, 2020. If you fail to answer the Complaint, a judgment may be taken against you for the relief demanded in the Complaint. A copy of the Complaint can be obtained from the Office of the Kanawha County Circuit Clerk at the Kanawha County Courthouse, Charleston, West Virginia.
