NOTICE OF INTENT TO CONVEY REAL ESTATE Pursuant to the provisions of Ch. 35, Art. 1, Sec. 10 of the W. Va. Code, the Trustees of the Queen Shoals Full Gospel Church herein provide notice that, on or after September 21, 2020, they intend to convey to Elk River Trail Foundation, Inc., a W. Va. nonprofit corporation, certain tracts of land on the waters of Queen Shoals Creek and Elk River in Union District, Clay County, W. Va., and Big Sandy District, Kanawha County, W. Va., described as follows: TRACT ONE: Beginning at a concrete right of way marker found at the intersection of the westerly right of way line of Clay County Route #1, and the northerly right of way line of a railroad, now or formerly owned by Consolidated Railcorp, thence leaving the right of way line of said Route #1, and going with the northerly right of way line of said railroad, with a curve to the right, the chord of which is S. 63-44 W., 223.27 feet to a point which is 33 feet north of the center of an old abutment, thence continuing with the railroad right of way line N. 23-00 W. 36.00 feet to a point, thence with a line, and a part of another line of parcel #2 hereinbelow described, N. 34-14 E. 56. 24 feet to a point on the edge of Queen Shoals Creek, thence with the edge of said creek N. 12-47 W. 25.00 feet to the southwest corner of the Betty Kohne property, thence going with the Betty Kohne property N. 68 18 E. passing an iron rod found at 43.50 feet, in all 163.50 feet to a point in the westerly right of way line of’ Clay County Route #1, thence leaving the Betty Kohne property and going with the westerly right of way line of Clay County Route #1, S. 28-55 E. 75.00 feet to the point of beginning, containing 0.375 acres; and TRACT TWO: Beginning at a point on the northerly right of way line of a railroad, now or formerly owned by Consolidated Rail Corp, said point is 69 feet north of the center of the western abutment of an old bridge across Queen Shoals Creek, thence going with the said right of way with a curve the chord of which is S. 84-54 W. 479.54 feet to a point in the original outside line of which this parcel is a part, thence leaving the railroad right of way and going with the original outside line N. 02-20 W. 120.00 feet to a point at the edge of Elk River, thence going with the edge of Elk River for six calls as follows: N. 78-46 E. 148.20 feet, N. 71-05 E., 78.51 feet, N. 78-39 E., 83.46 feet, N. 76-36 E., 94.08 feet, N. 84-01 E., 69.95 feet, S. 78-12 E., 33.41 feet to a point on the edge of Queen Shoals Creek, thence going with the edge of Queen Shoals Creek , S. 12-47 E. passing the southwest corner of the Betty Kohne property at 100.95 feet, in all 125.95 feet to a point at the edge of the creek, thence leaving the edge of the creek S. 34-14 W., 56.24 feet to the point of beginning, containing 1.914 acres; TRACTS ONE AND TWO are the same lands conveyed to Grantor by deed from William Hanson and Onita Hanson dated January 13, 1989, and recorded in the Office of the Clerk of the County Commission of Clay County, West Virginia, in Deed Book 148, page 676. TRACT THREE: That certain tract of land located at the confluence of Queen Shoals Creek and Elk River in Union District, Clay County, West Virginia, bounded on the south by the lands formerly owned by William Hanson, on the east by the county road, on the west by Queen Shoals Creek, and on the north by Elk River. TRACT THREE is the same land conveyed to Grantor by deed from Betty Kohne, et al., dated September 13, 2004, and recorded in the aforesaid Clerk’s office in Deed Book 195, page 792.
