NOTICE OF TRUSTEE’S SALE Pursuant to the authority vested in the undersigned J. Patrick Jones, Trustee in that certain Deed of Trust dated February 8, 2016, executed by Michael Reyburn and Jessi R. Reyburn which deed of trust is of record in the Office of the Clerk of Cabell County, West Virginia in Trust Deed Book 2605 at Page 413, the undersigned Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Trustee will sell the real estate described in the Deed of Trust, at a public auction on October 13, 2020, at 10:00 a.m. to the highest bidder at the east front door of the Courthouse of said County of Cabell, in Huntington, West Virginia, which real estate is more completely described as follows: PARCEL ONE All that certain lot, piece or parcel of land situate in the City of Huntington, Cabell County, West Virginia, and known and designated as Lot No. 3, as laid out by Holderby, Pennybacker and Harvey, said lot hereby conveyed fronting thirty feet on the south side of Third Avenue and extending back in a southerly direction 160 feet to a public alley. PARCEL TWO All that certain lot, piece or parcel of real estate situated in the City of Huntington, Cabell County, West Virginia, being known as part 35 x 160 feet of Lot Number Two (2) as laid out by Holderby, Pennybacker and Harvey, said lot hereby conveyed fronting 35 feet on the south side of Third Avenue and extending back in a southerly direction one hundred and sixty (160) feet to a public alley. PARCEL THREE A1l that certain Jot, piece or parcel of land situate in the City of Huntington, Cabell County, West Virginia, and located on the south side of West Third Avenue between First Street and Johnsons Lane, described as follows: BEGINNING at a point in the south line of Third Avenue West distant 270 1/2 feet east of the intersection of the eastern boundary line of Johnsons Land with the southern boundary line of Third Avenue; thence southerly and at right angles to the southern boundary line of Third Avenue and parallel to the east property line of the property herein conveyed, and along with a division line between the property of W. J. Waugh (now Clyde Slater and Charles A. Clark) and MP. Wiswell (now Hilda Bailey Howland) as designated in a deed executed by them and their wives by deed dated the 4th day of January, 1923, of record in the Office of the Clerk of the county Court of Cabell County, West Virginia, in Deed Book No. 201 at Page 145, 74 1/2 feet to a point; thence westerly and parallel with the southern boundary line of Third Avenue West 2 feet to a point; thence southerly and at right angles to the southern boundary line of Third Avenue and parallel with the eastern boundary line of the property herein conveyed 85 1/2 feet to a point in the northern boundary line of a 20 foot public alley between Third and Fourth Avenue; thence easterly and along with the said northern boundary line of the said 20 foot public alley 79 feet to a point; thence northerly and at right angles to the northern boundary line of said public alley and the southern boundary line of Third Avenue and along the eastern boundary line of the property hereby conveyed 160 feet to a point in the southern boundary line of Third Avenue West; thence westerly and along the southern boundary line of Third Avenue West 77 feet to the point of BEGINNING. TERMS OF SALE 1. Cash in hand paid on the day of sale. 2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, right of ways and easements of any nature whatsoever. 3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code 11-22-2. 4. The subject property will be sold in “AS IS” condition. The Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed. 5. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. 6. The Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above. 7. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid. 8.
