NOTICE OF TRUSTEE SALE Pursuant to the authority vested by Deed of Trust dated the 13th day of November, 2009, Sovereign Group, LLC, Grantor, to Philip A. Vallandingham and Samuel A. Vallandingham, Trustees, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2316 beginning at page 323, the undersigned, MVB Bank, by virtue of that certain Assignment of Loans, Security Instruments, and Other Lan Documents, which is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Assignment Book 120 beginning at page 669, and the undersigned, Daniel T Yon and Ralph J. Hagy, substituted Trustees, by Substitution of Trustees of record in the office of the Clerk of the County Commission of Cabell County in Trust Deed Book 405 at page 327 having been requested to do so by the Lender, and default having been made under the terms and conditions of said Deed of Trust, and the provisions of said Deed of Trust concerning acceleration having been complied with by the Lender and present holder of the note, said substituted Trustees shall sell at public auction on October 13, 2020 at 1:20 p.m. at the front steps of the courthouse of Cabell County, West Virginia, the following real estate more particularly described as follows: All that certain lot, piece or parcel of land situate in the City of Huntington, Cabell County, West Virginia, known and designated on a map of KITE ADDITION, a copy of which map was recorded in the Cabell County Clerk’s office on 5th July, 1919, in Deed Book 164, at Page 169, as LOT NUMBER THIRTY-THREE (33) and being more particularly described as follows: BEGINNING at a point in the South line of Kite Avenue at the corner between Lots 32 and 33; thence with the South line of Kite Avenue in an Easterly direction 35.00 feet to a point at the intersection of the South line of Kit Avenue with the West line of an alley; thence with said alley line in a Southerly direction 101.90 feet to a point at the intersection of the West line of said alley with the North line of another alley; thence with the North line of said alley, Westerly 54.89 feet to a point; thence with the line between Lots 32 and 33 in a Northerly direction 100.00 feet to the place of BEGINNING. TERMS OF SALE: Ten percent (10%) of total bid amount cash in hand on day of sale. Remainder due within 30 days from date of Trustee Sale. Payment for unpaid real estate taxes to be assumed by the purchaser. Subject to any and all assessments and taxes against said property, and all prior liens and encumbrances of any nature whatsoever. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 2 of Chapter 11 of the West Virginia Code. Any sale hereunder may be adjourned from time to time without any notice other than the oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Subject to the right of the Internal Revenue Service to redeem the property as provided by Section 7425 of the Internal Revenue Code, as amended. Any sale may be conducted or adjourned by the designated agents or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as substituted Trustee.
