NOTICE OF TRUSTEE’S SALE Pursuant to the authority vested in the undersigned Trustee by Deed of Trust dated December 2, 2014, executed by Kenneth D. Adkins and Clara P. Adkins, which deed of trust is of record in the Office of the Clerk of Cabell County, West Virginia, in Trust Deed Book 2554 at Page 650, the undersigned Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Trustee will sell to the highest bidder the real estate described in the Deed of Trust, at a public auction to be conducted at 10158 Left Fork Union Ridge Road, Lesage, West Virginia, 25537, the location of the Property, on November 18, 2020 at 12:00 p.m. (Registration to begin at 11:00 a.m.) which real estate is more completely described as follows: A parcel of land located on the left fork of Union Ridge Road, Union District, Cabell County, West Virginia more particularly described as follows: BEGINNING at the northeast corner to Parcel “I” of the Knabb and Krug lands DB 668, at page 52; thence south 12 21′ East 362.20 feet to the northerly corner to a 4.0 acre parcel by a previous survey (6/8/95). Thence North 88 55′ West 756.30 feet; Thence north 29 30′ West 362.20 feet; thence North 87 30′ East 858.00 feet to the place of beginning, containing 6.25 acres more or less as surveyed by John H. Gibson, 152 Iroquois Trail, Ona, WV 25545. TERMS OF SALE 1. The successful bidder (“Purchaser”) shall pay a Ten Percent (10%) nonrefundable down payment payable to the Trustee at the conclusion of the auction with balance due and payable within thirty days from the date of the Sale payable by certified check, cashier’s check or wired funds. In addition to the sales price, the Purchaser will be responsible for a ten percent (10%) “Buyer’s Premium” which will be added to the final bid amount and due at time of sale payable to Behm’s Auction & Real Estate Services LLC to determine final aggregate contract price. 2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, right of ways and easements of any nature whatsoever 3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code 11-22-2. 4. The subject property will be sold in “AS IS” condition. The Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed. 5. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. 6. The Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above. 7. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid. 8.
