PUBLIC NOTICE Notice is hereby given that the City of South Charleston (“City”) will hold a public hearing in the City Council Chambers at 401 D Street, South Charleston, West Virginia, beginning at 7:30 p.m. on November 19, 2020, to consider a proposed amendment to the City’s Charter. Any qualified voter or freeholder of the City of South Charleston may appear at this hearing and file objections in writing. If no objections are filed, this proposed amendment shall become effective on December 3, 2020. The purpose of this proposed amendment is to provide that the City’s municipal election dates coincide with state and county primary and general election dates starting in the year 2026. Specifically, the proposed amendment provides that Article XIV, Section 14.1 of the City Charter would read as follows: SECTION 14.1 WHEN PRIMARY AND GENERAL ELECTIONS TO BE HELD; TERM OF CITY OFFICIALS ELECTED UNDER CHARTER, ETC. The first primary election under this Charter amendment for the nomination of candidates for election to the municipal offices provided for in this Charter shall be held on the second Saturday in April beginning after the year 2023. The second primary election under this Charter shall be held in conjunction with the state and county primary election administered by the clerk of the county court of Kanawha County, in the year 2026. West Virginia Constitution, Article IX, Section 9, designated the office of the county court as county commission. Subsequent primary elections shall be held in conjunction with the state and county primary election administered by the clerk of the county court of Kanawha County, West Virginia, in each fourth year thereafter. The first general election under this Charter amendment shall be held on the first Saturday in June in the year 2023. The second general election under this Charter amendment shall be held on the first Tuesday following the first Monday in November, 2026, in conjunction with the state and county general election administered by the clerk of the county court of Kanawha County, West Virginia. Subsequent general elections shall be held on the first Tuesday following the first Monday in November in conjunction with the state and county general election administered by the clerk of the county court of Kanawha County, West Virginia, in each fourth year thereafter. The term of office of all municipal officers elected in the first general election held under this Charter and these Charter amendments, except members of the City Executive Committees, shall be for a term commencing on the first day of July in 2023 and continuing for a period of three years, or until such time thereafter as their respective successors shall have been elected or appointed and qualified. The term of office of all municipal officers elected in subsequent elections held under this Charter and these Charter amendments, except members of the City Executive Committees, shall be for a term commencing on the first day in January which is not a Saturday, Sunday, or holiday in the year following each election year provided for herein and continuing for a period of four years, or until such time thereafter as their respective successors shall have been elected or appointed and qualified. The terms of office of all municipal officers and of members of the City executive committees elected under this Charter amendment shall be for a period of four years, except where provided otherwise under this Charter and Charter amendments.
