NOTICE OF SUCCESSOR TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustees, Eric M. Johnson and R. Douglas Calderwood, by that certain Deed of Trust made by Gregory Todd Rider, dated May 19, 2014 and recorded May 20, 2014 in the office of the Clerk of the County Commission of Cabell County, West Virginia in Trust Deed Book 2530 at page 592, the said Successor Trustees acting by virtue of that certain Appointment of Successor Trustee dated October 1, 2020 and recorded October 14, 2020 in the aforesaid Clerk’s office in Substitute Trustee Book 405, at page 499, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Cabell County, West Virginia, on November 19, 2020 at 10:00 a.m., all that certain lot, piece or parcel of real property, together with improvements thereon, situate in Huntington, Barboursville District, Cabell County, West Virginia, being more particularly bounded and described as follows: PARCEL 1: All that certain lot, piece or parcel of land situate, lying and being on the east side of the Ohio River Road about five miles above Huntington, Cabell County, West Virginia, in Barboursville district, Cabell County, West Virginia, and being more particularly described as follows: BEGINNING at a point in the east line of State Highway No. 2, 50 feet above the east end of a culvert which is 860 feet below the store building of W. H. Kyle; thence running up the hill S. 59 15 E. 509.85 feet to a stake witnessed by 2 chestnut oaks which are marked as pointers; thence N 37 00 E. 80 feet to a forked Chestnut oak; thence running down the hill, N. 59 15 W. 507 feet to the east line of the Highway; thence with same, S. 39 00 W. 80 feet to the BEGINNING, containing 0.933 acres. PARCEL 2: All that certain lot, piece of parcel of land situate, lying and being on the East side of the Ohio River Road about five miles above Huntington, Cabell County, West Virginia, in Barboursville District, Cabell County, West Virginia, and being more particularly described as follows: BEGINNING at a point in the southeasterly line of W. Va. State Highway #2, at the southwesterly corner of Parcel 1 of the property of James T. and Nancy A. Fallon, Deed Book 857, page 570; thence with the southeasterly line of W. Va. State Highway #2, S. 39 00′ W., 8.00 feet to a point; thence leaving W. Va. State Highway #2, S. 53 50′ E., 510.00 feet to a point; thence N. 34 15′ E., 56.16 feet to a point in the southeasterly corner of Parcel 1, Deed Book 857, page 570; thence with the south line of Parcel 1, N. 59 15′ W., 509.84 feet to the place of BEGINNING. At the time of execution of the deed of trust, the grantor represented that the address of the property was 6013 Ohio River Road, Huntington, WV 25702. TERMS OF SALE: The Premises will be sold “AS IS, WHERE IS,” in its present condition and with all faults and defects, if any. The property will be conveyed by deed with no covenants of warranty of title. The property shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The property shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground. The property will be sold for cash in hand on the date of sale to the highest bidder. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Successor Trustees and The Ohio Valley Bank Company shall not be responsible for the removal of any person or personal property from the Premises. Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
