FINDING OF NOSIGNIFICANT IMPACTAND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS October 22, 2020City of Huntington800 5th AvenueHuntington, WV 25701304-696-5540These notices shall satisfy two separate but related procedural requirements for activities proposed to be undertaken by Habitat for Humanity of the Tri-State, Inc. and Coalfield Development Corporation.REQUEST FOR RELEASE OF FUNDS On or about November 9, 2020 the City of Huntington will submit a request to the U.S. Department of Housing and Urban Development for the release of HOME funds under Home Investment Partnership Program, Title II of the Cranston-Gonzales National Affordable Housing Act of 1990, as amended, to be undertake the following:2019 and 2020 Program Income funds The use of HOME funds will be used to assist with the purchase of materials and services for the development of three (3) single family residential units to provide affordable housing opportunities to be located at (1129) Minton Street, (1369) 9th Avenue, and 3205 Cyrus Creek Road, Barboursville, WV. Estimated HOME cost: $172,500.2017, 2018 and 2019 Entitlement funds The funds will be used to assist with the purchase of materials and services, and labor costs associated with the renovation and rehabilitation of the 2nd floor of the Old Fort Gay High school located at 675 Court Street, Fort Gay, WV – Estimated HOME cost: $781,000.FINDING OF NOSIGNIFICANTIMPACT The City of Huntington has determined that the project(s) will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Office of Development & Planning, 800 5th Avenue, Room L7, Huntington, WV and may be examined or copied weekdays (8:30) A.M to (4:00) P.M.PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR(s) to the Office of Development & Planning, 800 5th Avenue, Room L7, Huntington, WV. All comments received by November 6, 2020 will be considered by the City of Huntington prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.RELEASE OF FUNDS The City of Huntington certifies to the U.S. Department of Housing & Urban Development that Steve Williams in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The U.S. Department of Housing & Urban Development’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Huntington to use Program funds.OBJECTIONS TO RELEASE OF FUNDS U.S. Department of Housing and Urban Development will accept objections to its release of fund and the City of Huntington’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Huntington; (b) the City of Huntington has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by U.S. Department of Housing and Urban Development; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
