BOGGS, SHERIFF OF JACKSON COUNTY, WEST VIRGINIA Notice is hereby given to AFRV Holdings LLC, First Federal Savings & Loan Association, Frontier West Virginia, Inc., Unknown Persons/Owners, and Anthony J. Boggs, Sheriff of Jackson County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Jackson County, West Virginia, and is known as Civil Action No. CC-18-2020-C-65, and styled Appalachian Power Company vs. AFRV Holdings LLC, et al. Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate, lying, and being on the waters of Big Mill Creek, and just below the City of Ripley, Ripley District, Jackson County, West Virginia, identified as Tax Map 12, Parcel 87, and recorded in the office of the Clerk of the County Commission of Jackson County, West Virginia, in Deed Book 472, at page 86, and being more particularly bounded and described as follows: 8.70 AC PROGLER FARM Beginning at a point in the center of Mill Creek Channel now changed, now being the center of Clay Lick and Bull Frog Creeks, and in the right of way line of the western side of U.S. I-77; thence with the said right of way line, N. 20 deg. E. 1,516.00 feet to a post set as a corner to the Brownie Beegle Lot; thence with the same N. 52 deg. 15′ W. 194.00 feet to a gas pipe; thence S. 46 deg. 45′ W. 142.50 feet to a stake; thence N. 44 deg. 30′ W. 196.50 feet to a point in the center of the Bull Frog public road; thence with the center and meanderings of said road S. 42 deg. 45′ W. 136.00 feet; thence S. 11 deg. W. 200 feet; thence S. 1 deg. W. 500 feet; thence now leaving the road S. 1 deg. E. 238 feet to a point in mouth of Clay Lick Creek, a corner of the corporation line of the City of Ripley; thence down the center and with the meanderings of Clay Lick Creek, after channel of Mill was changed (now Clay Lick) S. 2 deg. E. 535 feet to the place of beginning, containing 8.70 acres, more or less. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Jackson County Circuit Clerk’s office at 100 Court Street, Ripley, West Virginia, 25271, for the purposes of appearing and defending. The Petition for Condemnation/Right of Entry may also be obtained from the attorneys for Appalachian Power Company, Stephen F. Gandee, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation/Right of Entry will occur on December 9, 2020, at 10:00 a.m., in the Circuit Court of Jackson County, West Virginia, located at 100 Court Street, Ripley, West Virginia, 25271, before the Honorable Lora Dyer. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
