IN THE CIRCUIT COURT OF KANAWHA COUNTY, WEST VIRGINIA Civil Action No. 20-C-912 Honorable Tod J. Kaufman DALE REID and CARYN MCDANIEL, Petitioners, v. THE ESTATE OF CARROLL J. MANLEY, Respondent. ORDER GRANTING PETITIONERS’ MOTION FOR ORDER OF PUBLICATION ON A PREVIOUS DAY came Petitioners Dale Reid and Caryn McDaniel, by counsel, Bailey & Wyant, PLLC, Michael W. Taylor, and Harrison M. Cyrus, and moved this Court to grant a Motion for Order of Publication for service for The Estate of Carrol J. Manley and unknown defendants by newspaper publication pursuant to Rule 4(e)(C) & (E) of the West Virginia Rules of Civil Procedure. Based upon the averments set forth in Motion for Order of Publication, the supporting affidavit of due diligence, and supporting exhibits, this Court FINDS that the Petitioners have used due diligence to ascertain the residence or whereabouts of members of The Estate of Carrol J. Manley, without effect. Moreover, it appears that there are or may be persons that may have an interest in the subject matter of this action whose names are unknown and who are made defendants by the general description of unknown defendants, it is hereby ORDERED that The Estate of Carrol J. Manley and unknown parties be served via publication. It is further ORDERED that Counsel for Petitioners forward an appropriate Legal Advertisement to a newspaper of general circulation in and for Kanawha County, West Virginia, and that such Legal Advertisement be published in said newspaper once a week for two (2) consecutive weeks, and that said newspaper return a Certificate of Publication upon completion of such.
