DeLong, Marie DeLong, Frontier West Virginia, Inc., Brady Wilford Allman, Columbia Gas Transmission, LLC, Unknown Persons/Owners, and Anthony J. Boggs, Sheriff of Jackson County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Jackson County, West Virginia, and is known as Civil Action No. CC-18-2020-C-77, and styled Appalachian Power Company vs. Michael P. DeLong, et al. Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company for property most recently recorded in Deed Book 338, at page 299, in the records of the Clerk of the County Commission of Jackson County, West Virginia, and situate on the waters of Big Run, Ravenswood District, Jackson County, West Virginia, and further identified as Tax Map 12, Parcel 11 (16.33 AC), and Tax Map 12, Parcel 18 (54.17 AC), and being more particularly bounded and described as follows: 16.33 AC SAND CREEK, RAVENSWOOD, JACKSON COUNTY 54.17 AC SAND CREEK, RAVENSWOOD, JACKSON COUNTY First Tract: Beginning at a Hickory; thence N. 25-3/4, E. 23-2/5 poles to an old division line; thence up the hill with said division line N. 68-1/4 W. 37-1/2 poles to a stake in another old line; thence with the same S. 53-1/2 W. 131-1/2 poles; thence S. 17 W. 31 poles to a stake; thence up the hill S. 50 E. 23-4/5 poles to a stake on ridge; thence S. 1/2 E. 26 poles to a fence; thence with said fence line N. 51 E. 85 poles; thence S. 42-1/2 E. 48 poles to the center of the road; thence six lines with said road N. 43 E. 11 poles; N. 11-1/2 E. 26 poles; N. 39-1/2 E. 11-1/2 poles; N. 14-1/2 E. 31-3/5 poles; N. 28 E. 13-2/5 poles; N. 42 E. 6 poles; thence leaving the road N. 63-1/4 W. 13 poles to the beginning , containing seventy-six (76) acres and one hundred (100) rods, more or less. R. with a public road S. 77-1/4 E. 26-3/5 poles to a corner of a lot; thence up the hill N. 3/34 E. 14 poles to a stake; thence S. 80 E. 10 poles to a stake in Roseberry and Ables line; thence up the hill N. 3-3/4 E. 22 poles to a stone; thence N. 1-3/4 E. 57-2/5 to a stone corner to Winters land on the ridge; thence N. 53 E. 84-3/5 poles to a Locust post in an old line; thence with the same S. 40 E. 40-3/4 poles to the center of Big Run Road; thence down said road and with the center thereof 5 lines: S. 25-/12 W. 24-4/5 poles; S. 34-3/4 W. 40 poles; S. 26-3/4 W. 12-3/5 poles; S. 29 W. 25-3/5 poles; S. 71-1/4 W. 27-1/5 poles to a Vannest corner in the center of the road near a Walnut tree above the road; thence leaving said road and following a new line S. 7 E. 45-1/2 poles to a Curry line passing two Sycamores, marked, on the East side of Big Run; thence down the hill with the same N. 80 W. 26-4/5 poles to a public road (hard road); thence S. 3-3/4 W. 2 poles and 19 links to the place of beginning, containing 55 acres, more or less. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Jackson County Circuit Clerk’s office at 100 Court Street, Ripley, West Virginia, 25271, for the purposes of appearing and defending. The Petition for Condemnation/Right of Entry may also be obtained from the attorneys for Appalachian Power Company, Stephen F. Gandee, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation/Right of Entry will occur on January 27, 2021, at 2:00 p.m., in the Circuit Court of Jackson County, West Virginia, located at 100 Court Street, Ripley, West Virginia, 25271, before the Honorable Lora Dyer. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
