Hager, Randy Lee Foster, Michael Lee Dibbs, Unknown Persons/Owners, and Sonya M. Dingess Porter, Sheriff of Logan County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”) that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Logan County, West Virginia, and is known as Civil Action No. CC-23-2020-C-122, and styled AEP West Virginia Transmission Company, Inc. vs. Alla L. Hager, et al. Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of AEP West Virginia Transmission Company, Inc. situate in Chapmanville District, Logan County, West Virginia, and identified as Tax Map 111, Parcel 22, and recorded in Deed Book No. 102, at page 146, in the office of the Clerk of the County Commission of Logan County, West Virginia, and bounded and described as follows: 22 ACRES GUYAN RIVER NEAR BIG CREEK Beginning at a stake by State Road Right-of-way and on the line between Laura L. Hager and N. B. Moberly lands now Allie Thomas land and running in a Easterly direction and with the old line of N. B. Moberly 480 (Four Hundred and Eighty) feet to a rock in the ravine, thence a straight line and with the old line of N. B. Mobley now Golden Hager, in a north easterly direction 1910 (nineteen hundred and ten) ft. to a large rock on the ridge in the head of the Golden Hager Hollow, thence with the meanders of the ridge and with the line of Stone Branch Coal Co. in a south westerly direction 1570 (fifteen hundred and seventy) feet to a black oak corner on the ridge and the old line of Roxie L. Hager (now B. L. Sanders) thence with the old line of Roxie L. Hager (now B. L. Sanders) running down the cemetery point in a westerly direction 1200 (twelve hundred feet to a corner stone at foot of hill, corner to B. L. Sanders and W. C. Hager, thence with the meanders of the hill and with the back line of W. C. Hager lot 110 (one hundred and ten) feet, and with A. M. Hager lot 170 (one hundred and seventy) feet, and with Allie Thomas lot (80) eighty feet, binding on all three lots (360) three hundred and sixty feet in a northerly direction to the North East corner of Allie Thomas lot thence with Allie Thomas line in an Easterly direction (300) three hundred feet to North West corner of Allie Thomas lot by State Road, thence with State Road Right-of-way in a North easterly direction 18 (eighteen) feet to the Beginning containing (22) twenty-two acres, more or less. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Logan County Circuit Clerk’s office at 300 Stratton Street, Logan, West Virginia, 25601, for the purposes of appearing and defending. The Petition for Condemnation/Right of Entry may also be obtained from the attorneys for AEP West Virginia Transmission Company, Inc., Stephen F. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation/Right of Entry will occur on February 2, 2021, at 10:00 a.m., in the Circuit Court of Logan County, West Virginia, located at 300 Stratton Street, Logan, West Virginia, 25601, before the Honorable Joshua Butcher. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
