NOTICE OF SUBSTITUTE TRUSTEES’ SALE FEBRUARY 19, 2021. NOTICE IS HEREBY GIVEN that the Substitute Trustees will conduct a sale of the below-described properties (“the Properties”) at the north front door of the Kanawha County Courthouse, 407 Virginia Street, Charleston, West Virginia on FRIDAY FEBRUARY 19, 2021 2:00 P.M. This sale will be made under that certain deed of trust (“the Deed of Trust”) dated August 9, 2019 between Larry Flot Investments, LLC and Jason Powell (“the Trustee”), recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 4377 at Page 82, to secure payment of a promissory note of the same date (“the Note”) in the principal amount of One Hundred Ninety-One Thousand One Hundred Dollars ($191,100.00). As shown by documents of record in said Clerk’s Office, the Deed of Trust and the Note are currently held by PS Funding, Inc. (“the Beneficiary”). Being authorized and empowered to designate and appoint one or more substitute trustees in the place and stead of the Trustee, the Beneficiary designated and appointed the undersigned W. Bradley Sorrells and Lindsay M. Stollings, as Substitute Trustees by that Notice of Substitution of Trustee recorded in said Clerk’s office on December 15, 2020, in Trust Deed Book 4471 at Page 499. DESCRIPTION OF PROPERTIES: The Properties subject to the Deed of Trust and to be sold by the Substitute Trustees consist of the following: PARCEL ONE All of the Substitute Trustees’ right, title, and interest in and to all that certain piece or parcel of property with a street address of 2016 Grant Avenue, Saint Albans, West Virginia 25177 and described in that Deed dated September 20, 2017, which is of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book Deed Book 2985 at Page 757 as: All of those two (2) certain lots or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of St. Albans, Kanawha County, West Virginia, and being all of Lots Nos. Two (2) and Three (3), of Block 15 in the Kanawha River Addition to the Belleville Estate, as shown upon a map of said addition which is duly of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Map Book 2, page 68. Being the same property conveyed to Larry Flot Investments, LLC by the said deed dated September 20, 2017. PARCEL TWO All of the Substitute Trustees’ right, title, and interest in and to all that certain piece or parcel of property with a street address of 838 Monmouth Street, Saint Albans, West Virginia 25177 and described in that Deed dated July 19, 2017, which is of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 2978 at Page 341, as: All those certain lots or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, having a frontage of one hundred forty (140) feet on the easterly side of Monmouth Street in the City of St. Albans, Kanawha County, West Virginia, being part of lots nos. 105, 107, 108, and 109 of section two of Walnut Hills Estates an addition to the City of St. Albans, as shown upon the map of said addition of record in the office of the clerk of the county commission of Kanawha County, west Virginia, in Deed Book 11, at page 72, and being more particularly bounded and described as follows: Beginning at an iron pin in the east line of said Monmouth Street, which said pin is located s. 16 00′ w., 510.00 feet, from the intersection of said east line of Monmouth Street and the south line of Kanawna Terrace, which iron pin is also located at the center of the front line of said lot no. 106; thence running through the said lot no. 106, s. 74 00′ e., 120.00 feet to a stake; thence with a line parallel to the east line of Monmouth Street, and running across a part of said lot no. 106, and all of lot nos. 107 and 108, s. 16 00′ w., 100.00 feet to a point in the common division line between lot nos. 108 and 109 of said section two; thence with the common division line between the last named lots, n. 74 00′ w., 20.00 feet to a point in said line; hence running across the said lot no. 109, s. 16 00′ w., 40.00 feet to a stake in said lot; thence running through said lot no. 109, n. 74 00′ w., 100.00 feet to a stake in the front line of said lot no. 109 and in the east line of Monmouth Street; thence with the east line of Monmouth Street, n. 16 00′ e. (n. 16 00′ w. in prior deed), 140.00 feet to the point of beginning. Being the same property conveyed to Larry Flot Investments, LLC by the said deed dated July 19, 2017. TERMS OF SALE: 1. Cash in hand at the time and place of sale or such other terms as may be acceptable to the Substitute Trustees. At the sale, any person or entity may submit bid and, subject to the below-noted right of the Trustees to reject bids, may purchase the Properties if they are the highest bidder. 2. The sale of the Properties will be made subject to all exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record, if any, pertaining to said real estate, and any and all unpaid taxes assessed against said property. 3. Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. 4. The Substitute Trustees will first offer Parcel One separately, then Parcel Two separately. Then, both parcels will be offered together, with the minimum bid for both parcels being the sum of the highest bids of each when offered separately. 5. The Substitute Trustees reserve the right to reject any or all bids. 6. Conveyance shall be by special warranty deed, and the purchaser shall pay for all transfer stamps, recording fees, and other closing costs. 7. Each of the Properties will be sold AS IS, WHERE IS, in its present condition, with all faults and defects, without warranty of any kind. 8.
