NOTICE OF TRUSTEE’S SALE Notice is hereby given that by virtue of the authority vested in the undersigned, J. Nicholas Barth, Successor Trustee, by that certain Deed of Trust dated November 9, 2005, made by Larry D. McDonnell, II, to P. Michael Pleska and Thomas Graff, Jr., Trustees, of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, Trust Deed Book 3301, at page 139; the said J. Nicholas Barth acting as Successor Trustee by virtue of that certain Appointment of Successor Trustee dated January 8, 2021, of record in the aforesaid Clerk’s office in Trust Deed Book 4479, at page 720, and default having been made in the payment of the Note secured by the aforesaid Deed Of Trust, and having been requested in writing by United Bank, Inc., the owner and holder of the Note, the undersigned Successor Trustee will offer for sale, at public auction, to the highest bidder at the North Front Door of the Courthouse of Kanawha County, in Charleston, West Virginia, in the City of Charleston, West Virginia, on the 18th day of February, 2021, at 10:00 o’clock a.m., all that certain parcel of land, together with the improvements therein and the appurtenances thereunto belonging, situate in Elk District, Kanawha County, West Virginia, and being Lot No. 1 as set out and shown on a certain map made by Jr. R. Mason, dated March 24, 1959, and being the same interest in Lot No. 1 that was awarded to Mary Kathryn Childress and Helen Kay Buckner, two of the parties by that certain decree of the Circuit Court of Kanawha County, West Virginia, entered on the 22nd day of September, 1959, in that certain styled Luther J. Harless, et al, vs. Helen Kay Buckner, et al, and being more particularly described as follows: BEGINNING at an iron pin in the northwesterly corner of said Lot 1, thence S 14 E 175.83 feet to an iron pin; thence N. 78 30′ R. 74.78 feet to an iron pin in a 20 foot right of way line; thence continuing on the same course 20 feet, more or less, to the exterior line of the property conveyed; thence with said exterior line N. 14 W. 165 feet, more or less, to an iron pin in cement; thence N. 8 00′ W. 19.46 feet, more or less to a point in said exterior property line; thence leaving said exterior property line S. 71 W. 96.2 feet, more or less, to the place of beginning; and being the same property conveyed to Larry D. McDonnell, II, by deed dated November 8, 2005, and of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 2647, at page 572, reference to said deed and map is hereby made for a more particular description of the subject property. Said property having an address of 445 Heritage Drive, Elkview, West Virginia 25071. The referenced property will be conveyed with covenants of special warranty subject to all further covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground. TERMS OF SALE: Cash on hand at time of sale, subject to all prior liens and encumbrancers, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. Pursuant to the terms of the Deed of Trust, the Trustee/Successor Trustee may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
