NOTICE OF SPECIAL COMMISSIONER SALE Pursuant to the authority vested in the undersigned by Order of the Honorable Phillip M. Stowers of the Circuit Court of Putnam County, West Virginia entered the 25th day of September, 2019, the undersigned, Eric Embree, Special Commissioner will sell the below described real property at public auction at the North front door of old Courthouse building of Putnam County, West Virginia, on: Wednesday, October 23, 2019 at 10:00 a.m. The property is described as that certain parcel of land, together with all improvements thereon and the appurtenances thereto, and being more particularly described as follows: All of Lot No. Four (4) of Valley Hills as the same is shown and designated on a Map entitled “Valley Hills, Teays Valley Dist., Putnam Co., 1 Mile East of Hurricane, W.Va.,” dated February 10, 1949, of record in the Office of the Clerk of the County Commission of Putnam County, West Virginia, in the map file thereof, reference to which is made for a more particular description of said land. The parcel of land conveyed fronts 100 feet on State Route No. 34 and extends back a distance of 449 feet on the west and 465 feet on the east to the right of way line of the Chesapeake and Ohio Railway Company, and is 112.5 feet in width on the back along the railway right of way line, and contains 1.11 acres, more or less. LSOT: Deed Book 429, Page 858 dated June 19, 2002, Office of the Clerk of County Commission of Putnam County, West Virginia and recorded on July 1, 2002. The property will be conveyed in an “AS IS, WHERE IS” physical condition by Deed containing no warranty, express or implied. The Special Commissioner does not warrant correct description of the property sold, quality of title, fitness or quantity of real property being sold. Special Commissioner shall convey title to the real property by quitclaim deed; 2. The property is being sold subject to any and all assessments and taxes against said property, and all prior liens and encumbrances of any nature whatsoever; 3. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 22 of Chapter 11 of the West Virginia Code; 4. The Special Commissioner reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of sale described above or any adjournment thereof; 5. The successful bid is contingent upon approval of the Circuit Court of Putnam County, West Virginia which must be obtained prior to the issuance of any deed. The successful bidder shall not take possession or make improvements in the premises until the Special Commissioner’s deed is delivered and/or recorded; 6.
