TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated April 7, 2009, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 3638, at Page 979, Mary M. Bateman did convey certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Trustee by virtue of Court Order recorded on November 2, 2020, in Book 4461 at Page 185 in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Trustee having been instructed by Bank of New York Mellon Trust Company, N.A. as Trustee for Mortgage Assets Management Series I Trust to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on February 16, 2021 at 4:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Chas E District, Kanawha County, West Virginia, and more particularly described as follows: All that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate on the westerly side of Thompson Street in the City of Charleston, Kanawha County, West Virginia, more fully described as follows: BEGINNING at a point on the westerly side of Thompson Street located 36 feet northerly from Lewis Street; thence with the westerly side of Thompson Street in a northerly direction 40 feet to a stake; thence leaving Thompson Street and running in a westerly direction in a line parallel with Lewis Street 80 feet to a point; thence with a line parallel with Thompson Street in a southerly direction toward Lewis Street 40 feet to a stake; thence in a straight line in an easterly direction 80 feet to the place of beginning, and being part of Lot 1 in Block F of the Johnson Subdivision in the City of Charleston. And being the same real estate conveyed unto Clarence Bateman, Sr., and Mary M. Bateman, his wife, as joint tenants with rights of survivorship, by Stella A. Lawrence, widow of David H. Lawrence, by Deed dated May 24, 1972 and of record in the aforesaid Clerk’s Office in Deed Book 1656 at page 221. The said Clarence Bateman, Sr. died in Kanawha County, West Virginia on June 19, 1997, and by virtue of the survivorship provision in the ownership deed Mary M. Bateman as survivor was vested with fee ownership. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 603 Thompson St, Charleston, WV 25311. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
