NOTICE OF TRUSTEE’S SALE Notice is hereby given that by virtue of authority vested in the undersigned Trustee by that certain deed of trust executed by K P HOLDINGS, LLC to ROBERT LEVY AND RANDALL TRAUTWEIN, dated the 8TH day of OCTOBER, 2004, securing WESBANCO BANK, INC. FORECLOSURE, and recorded in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book No. 1969, at page 407, by which was conveyed to the said Trustees the hereinafter described real estate, to secure the payment of a certain note set out and described therein, and the owner and holders of said note, in exercise of the right and authority granted in the aforementioned deed of trust, having appointed FLYNN, MAX, MILLER & MILLER, LC as Substitute Trustee, by that certain Appointment of Substitute Trustee dated the 30TH day of APRIL, 2019, and recorded in the aforesaid Clerk’s Office in Bonds, Contracts and Leases Book 398, at page 720, and default having been made in the payment of said note, and the said FLYNN, MAX, MILLER & MILLER, LC, Substitute Trustee, having been requested so to do by the owner and holder of said note, shall sell to the highest and best bidder, on JUNE 13, 2019 at 10:00 A.M., at the FRONT DOOR of the Court House of Cabell County, West Virginia, the following described real estate: All that certain real estate in Kyle District, Cabell County, West Virginia, bounded and described as follows: Part of Lot No. 8, in Block 71 and part of the Easterly one-half of Lot No. 9 in Block 71 on Seventh Street between Sixth and Seventh Avenues, in the City of Huntington, West Virginia, and bounded and described as follows, to-wit: Beginning at a point in the West line of Seventh Street 100 feet South of the alley between Sixth and Seventh Avenue; thence Southerly and with said West line of Seventh Street 33-1/3 feet to a stake in said West line; thence Westerly and parallel with Seventh Avenue 80 feet to a stake in the East side of a private 10 foot alley; thence Northerly and parallel with Seventh Street and with the East line of said private alley 33-1/3 feet to a stake; thence Easterly and parallel with Seventh Avenue 80 feet to the place of Beginning, together with the privilege to use said private alley along in common with other owners of lots abutting on said private alley. Balance due in full 30 days from date of sale. Pursuant to the Deed of Trust, the Substitute Trustee may act by agent in the execution of the sale and Joe R. Pyle Complete Auction and Realty Service will assist with the sale as auctioneer. Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Substitute Trustee reserves the right to reject any or all bids. Conveyance shall be by special warranty deed, and purchaser shall pay for all stamps, recording fees, and other closing costs.
