NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated August 28, 2013, executed by Borrower(s), Brenda L Ewers, to Richard A. Pill, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 3983, at Page 386. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1007 Belmont St, Charleston, WV 25314. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated January 13, 2021, of record in the Clerk’s Office in Book 4480, Page 552. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 22nd day of March, 2021 at 10:30 a.m. All that certain lot, piece or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Charleston, South Annex Tax District (formerly London District), Kanawha County, West Virginia, fronting forty feet (40`) on the westerly side of Belmont Street (also known as Belmont Drive), being approximately the northern one-half (1/2) of a certain one-third (1/3) acre parcel heretofore conveyed by Amy C. Venable and husband to Thomas Hearn and wife, by deed dated April 16, 1944, filed and duly of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 672, at page 106-A, more particularly bounded and, described as follows: BEGINNING at an iron pin in the westerly line of Belmont Street at its intersection with the southerly line of a certain sixteen foot (16`) service line, as shown on the map hereinafter referred to; thence with the west line of Belmont Street, S. 1 10` W. 40 feet to an old iron pin, corner to Robert Donald Mundy and wife; thence with two lines of Mundy, N. 88 50` W. 50 feet to a point; thence N. 70 1l` W. 62.40 feet to an iron pin in the easterly line of a ten foot (10`) utility easement; thence N. 7 54` E. 90.84 feet to an iron pin at the intersection of the said line of said utility easement with the southerly line of the 16 foot service line; thence with the southerly line of the said service line, S. 48 25` E. 123.60 feet to the place of beginning, which parcel of land hereby conveyed is shown upon a plat thereof made by Field Engineering Co., dated October 24, 1955, filed and duly of record in the said Clerk`s Office in Deed Book 1154, at page 327. Subject to those covenants and restrictions contained in the deed from Amy C. Venable, et ux, unto Thomas Hearn, et ux, dated April 16, 1944, of record in the aforesaid Clerk`s Office in Deed Book 672, at page 103, as amended by agreement between said parties, dated October 7, 1950, filed and duly of record in the aforesaid Clerk`s Office in Deed Book 938, at page 451; subject further to an casement for an eight inch (8″) sewer line running across the northerly tip of the property hereby described. Being the same property conveyed to Brenda L Ewers by the Deed dated August 28, 2013 and recorded in Deed Book 2857 at Page 727 in the Office of the Clerk of the County Commission of Kanawha County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
