REQUEST FOR RELEASE OF FUNDS On or after March 26, 2021 the WVDO will submit a request to the HUD for the release of Community Development Block Grant-Disaster Recovery funds (CDBG-DR) under Public Laws 114-223, 114-254, and 115-31 of the Continuing Appropriations Act of 2017 (HUD/State Identification Number B-16-DL-54-0001), authorized by the Title 1 of the Housing and Community Development Act of 1974, as amended, (42 USC 5301 et. seq), to undertake the following project: Project Title: Stockton Greene Purpose: Stockton Greene (Project) will involve the acquisition of contiguous parcels and new construction of a multifamily residential rental development consisting of a four-story building with 43 units serving seniors who earn at or below 60% AMI. Location: 1618 & 1620 6th Avenue; 1617, 1619, 1621, 1621 1/2, 1623, 1625, 1625A, 1625B, 1625C, and 1627A 7th Avenue; all addresses in Charleston, Kanawha County, WV 25387 Estimated Cost: Estimated total Project cost is $9,727,478 and estimated CDBG-DR funding $5,540,000 FINDING OF NO SIGNIFICANT IMPACT The WVDO has determined that the Project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional Project information is contained in the Environmental Review Record (ERR). The ERR is available for review at https://wvfloodrecovery.com/ or by U.S. mail. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the WVDO. All comments received by March 25, 2021 will be considered by the WVDO prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. RELEASE OF FUNDS The WVDO certifies to HUD that Jennifer L. Ferrell in her capacity as Director, Community Advancement and Development, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Stockton Greene Limited Partnership to use HUD program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of fund and the WVDO’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the WVDO; (b) the WVDO has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the Project is unsatisfactory from the standpoint of environmental quality.
