NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated December 29, 2010, executed by Borrower(s), Jeffrey L Moore and Eugenea A Moore, to P. Micheal Pleska and F. T. Graff, Jr., the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 3771, at Page 387. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 12306 Elk River Road, Clendenin, WV 25045. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 9, 2021, of record in the Clerk’s Office in Book 4486, Page 804. Welch Snyder; thence with said right of way line and in a direction up Elk River, S. 67 degrees 59 minutes East, 74.00 feet to an iron pin; thence leaving said U.S. Rote 119 and with the common division line between the herein described and conveyed parcel and a parcel now or formerly owned by Henry B. Snyder, South 27 degrees 55 minutes West, passing an iron pin at 78.49 feet and passing a second iron pin at the top of the bank at 190.17 feet (erroneously set forth through a scrivener`s error in the Deed conveying said property to A. C. Snyder, as in all 219.17 feet, more or less, to an iron pin in the top of the bank of Elk River), in all 219.17 feet to a point at the low water mark of Elk River; thence running down said Elk River with the meanders thereof at low water mark in a northwesterly direction 84 feet, more or less, to a point at the low water mark of Elk River, common rear coiner between the herein described and conveyed parcel and said parcel formerly owned by I. Welch Snyder, thence with the common division line between the herein described and conveyed parcel and said I. Welch Snyder parcel, N 27 degrees 55 minutes East, passing an iron pin at 69.00 feet, more or less in all 173.59 feet, more or less, to the iron pin in said southwesterly right of way line of U.S. Route 119 at the place of beginning; all as shown and laid down on a Map attached to that certain Deed dated August 22, 1967, from Daisy Dean Snyder, widow to A.C. Snyder, filed and of record in the aforesaid County Clerk`s Office in Deed Book 1500, at Page 115; and being all of the same property unto Jeffrey L. Moore and Eugena A. Moore, husband and wife, from Victoria D. Graham, by Deed dated March 6,1996, and recorded in the aforesaid Clerk’s office in Deed Book 2382, at page 781. This conveyance is expressly made subject to the exception of all minerals and mineral rights and interest that have been heretofore reserved of record by former owners in the chain of title. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
