REQUEST FOR RELEASE OF FUNDS On or about Tuesday, May 11, 2021 the West Virginia Development Office will submit a request to the U.S. Department of Housing and Urban Development for the release of Community Development Block Grant Disaster Recovery funds under Public Laws 114-223, 114-254, and 115-31 of the Continuing Appropriations Act of 2017 (HUD/State Identification Number B-16- DL-54-0001), authorized by the Title 1 of the Housing and Community Development Act of 1974, as amended, (42 USC 5301 et. seq), to undertake a project under the RISE WV Single Family Rehabilitation and Reconstruction Program for site WV-FL16-01440(NL). This project, in turn, will promote the well-being of the community facilitating long-term recovery. Proposed activities consist of addressing storm-related damage to the residence which includes placement of a new MHU to bring to current minimum residential property standards. Utility installation will be completed. The home site is not located in the floodplain. The applicant is going to relinquish ownership of the original property. The State of West Virginia will be assisting with the transition of ownership of the damaged MHU and parcel to state partner for reducing future disaster risks and maintaining restrictions in perpetuity. The program will assist with demolition of the original damaged MHU. The project will include the acquisition of property where the MHU will be placed. Placement of the MHU will take place at 225 Panther Mountain, Elkview, WV. The estimated total HUD funding for this project is $229,000. The estimated timeframe for this project is 6 months. FINDING OF NO SIGNIFICANT IMPACT The West Virginia Development Office has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the West Virginia Community Advancement and Development Office at 1900 Kanawha Boulevard East, Building 3, Suite 700 Charleston, WV 25305 and may be examined or copied weekdays 9 A.M. to 5 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the West Virginia Development Office or email the West Virginia Development Office at [email protected]. All comments received by Monday, May 10, 2021 will be considered by the West Virginia Development Office prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. ENVIRONMENTAL CERTIFICATION The West Virginia Development Office certifies to the U.S. Department of Housing and Urban Development that Jennifer Ferrell in her capacity as Director of West Virginia Community Advancement and Development consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the West Virginia Development Office to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of fund and the West Virginia Development Office’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the West Virginia Development Office; (b) the West Virginia Development Office has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Potential objectors should contact HUD to verify the actual last day of the objection period.
