NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated July 28, 2017, executed by Borrower, Buddy L. Bonsall, Unmarried, to Vance Golden, Attorney, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 4254, at Page 681. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 401 McKinley Ave, Charleston, WV 25314. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated June 23, 2020, of record in the Clerk’s Office in Book 4432, Page 682. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 25th day of May, 2021 at 10:15 a.m. All that certain lot, tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Loudon District, Kanawha County, West Virginia, and being more particularly bounded and described as follows: Beginning at an iron pin at the common corner of Lots 400 and 424 of Fort Hill in the westerly line of an unnamed street which runs between McKinley Avenue and Sheridan Circle, which said point bears S. 65 07` W. 83.26 feet from the intersection of the southerly line of McKinley Avenue, extended with the westerly line of said unnamed street, extended, the said beginning iron pin being opposite and 40 feet from Lot 169 of Fort Hill; thence leaving said unnamed street and running N. 30 44` W. 125.82 feet with the dividing line between Lots 400 and 424 to an iron pin in the line of Lot 423; thence N. 62 36` E. 80.00 feet with the dividing line between Lots 423 and 424 to an iron pin in the southerly line of McKinley Avenue; thence running with the southerly line of McKinley Avenue with a curve to the left having a radius of 460.00 feet, the chord of which bears S. 30 44` E. 103.87 feet to an iron pin at the point of a reverse curve to the right; thence with said curve to the right having a radius of 20.85 feet and a tangent distance of 25.90 feet and the chord of which bears S. 13 51` W. 32.48 feet to an iron pin in the westerly line of above mentioned unnamed street; thence with the westerly line of said unnamed street S. 65 07` W. 57.36 feet to the beginning, and being all of Lot No. Four Hundred Twenty-Four (424) of Fort Hill, as shown upon a map made by Harry G. Colebank, Engineer, dated June 1954, and also shown on a map made by J. Lewis Hark, Reg. Prof. Engr. Dated June 10, 1954, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 1099, at Page 106. This conveyance is made expressly subject to the restrictive covenants and agreements contained in the Deed from Fort Hill Company, a corporation, to Leonard Allen Brown and Betti S. Brown, his wife, dated July 14, 1954, and recorded in the aforesaid Clerk`s Office in Deed Book 1099, at Page 103. Being the same property conveyed to Buddy L. Bonsall by the Deed dated July 28, 2017 and recorded in Deed Book 2978 at Page 761 in the Office of the Clerk of the County Commission of Kanawha County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
