NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated July 27, 2010, executed by Borrower(s), Harley E Elkins, to Vance Golden, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 3736, at Page 30. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 209 American Way, Sissonville, WV 25320. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated May 10, 2021, of record in the Clerk’s Office in Book 4508, Page 312. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 15th day of June, 2021 at 10:30 a.m. That certain parcel of real estate, along with the improvements thereon and the appurtenances thereunto belonging, situate in Poca District, Kanawha County, West Virginia and being more particularly bounded and described as follows: Beginning at a point located in the northeasterly side of a 30` public road and a common front property corner to a 0.681 acre parcel of land, which is being hereby described and a 2.01 acre parcel of land. Thence, running with said 30` public road N. 30-10 W. 185.60` to a point also located in the northeasterly side of said 30` road. Thence, turning and running with same aforementioned 30` public road N. 44-34 W. 35.63` to a point which is the front common property corner to parcel being hereby described and a 4.90 acre tract of land. Thence, leaving said 30` public road right of way and running with the common division line of said 0.681 acre parcel and said 4.90 acre parcel N. 75-15 E. 190.30` to a point located along the common division line of aforementioned two parcels. Thence, turning and running with the same common division line of said two tracts N. 29-20-10 E., 10.40` to a point which begins to divide property being hereby described and a 2.01 acre parcel of land. Said point is also the beginning point and a centerline point of a 15` easement for egress and ingress that will follow along the next four calls to the aforementioned 30` public road. These four calls divide said 0.681 acre tract and said 2.01 acre tract. Thence, leaving said 4.90 acre parcel and running with the common division line of said 0.681 acre parcel and said 2.01 acre parcel S. 15-50 E. 85.00`; S. 08-00 W., 85.50`; S. 40-00 W., 97.00 and S. 82-15 W., 24.00` to the place of beginning and containing 0.681 acres or 29,680.33 square feet and being situate along the waters of Samuels Branch, Poca District, Kanawha County, West Virginia. Property hereby described is owned by Jerry E. and Doris J. Burford and recorded in Deed Book 2693 at Page 104. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
