NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated December 31, 2008, executed by Borrower(s), Billy R Wilson, to Philip Hereford, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 3616, at Page 716. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 4050 Spring Fork Dr, Charleston, WV 25306. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated May 10, 2021, of record in the Clerk’s Office in Book 4508, Page 305. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 15th day of June, 2021 at 10:45 a.m. All that lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate on the waters of Campbell`s Creek in Malden District, Kanawha County, West Virginia, and being part of a 1.33 acre tract of land, and being shown upon a map thereof entitled, “Showing A 5 Acre Tract of Land and Division Lines Between Sawyer Dearien and Ira Armstrong On Spring Fork of Campbell`s Creek, Malden District, Kanawha County, W. Va., Surveyed December 5, 1948. Scale 1` =100` P.H. Hackney, Engr-Charleston, W. Va. File No. 1108,” which said map is of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 860 at page 448, all subject, however, to the reservations and restrictions set forth, if any there be, in prior deeds, said parcel of land being more particularly bounded and described as follows: BEGINNING at a point at a T. iron rail driven by a wire fence on the southeast side of a house and in the old Shrewsbury line, the same being a corner to a 1.23 acre tract of land owned by Homer Armstrong, formerly Ira Armstrong; thence running with said Armstrong line N. 77 E. a distance of 208 feet, more or less, to a T. rail; thence running S 37 30` E., a distance of 95 feet, more or less, to a point; thence running S. 77 W., a distance of 208 feet, more or less, to a point in the Shrewsbury line; thence running with said Shrewsbury line, N. 37` 30` W., a distance of 95 feet, more or less, to the place of beginning; There is, however, EXCEPTED and RESERVED from this conveyance that portion of Spring Fork Drive, which crosses across the easterly end of the property herein conveyed; however, it is understood that the parties of the second part herein, their heirs and assigns, shall have the right to use said easement and right of way as a means of ingress and egress to and from the property herein conveyed, and that, as per former deed from Gordon B. Dearien and Opal E. Dearien, his wife, to Billy R. Wilson and Esther J. Wilson, his wife, said Gordon B. Dearien and Opal E. Dearien, their heirs and assigns, do hereby continue reservation of the right to use the same as a means of ingress and egress. Subject to the reservation by Gordon B. Dearien and Opal E. Dearien, his wife, of the right to use the cellar house, wash house and water well, which are not located on a portion of the property herein conveyed for and during their lifetime. Only and upon their deaths shall those rights cease and terminate; however, it is understood that they have the right to use these buildings located on the property previously conveyed to the parties herein for and during their lifetime only. Being the same property conveyed to Billy R Wilson by the Deed dated December 31, 2008 and recorded in Deed Book 2735 at Page 758 in the Office of the Clerk of the County Commission of Kanawha County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
