NOTICE OF TRUSTEE’S SALE NOTICE IS HEREBY GIVEN that by virtue of authority vested in the undersigned Trustee by that certain Deed of Trust executed by Roy Holland and Denise Holland, to Garry L. Boothe and W. Merton Prunty, Trustees, either of whom may act, dated the 14th day of April, 2009, and recorded in the Office of the Clerk of the County Commission of Wayne County, West Virginia, in Trust Dee Book No. 683, Pg. 758. which conveyed unto the said Trustees the hereinafter described real estate to secure the payment of that certain indebtedness set out and described therein, and by Substitution of Trustee Agreement dated the 12th day of January, 2021, and recorded in said Clerk’s Office in Trust Deed Book No. 832, Pg. 251, wherein the undersigned Trustee was appointed as successor to Garry L. Boothe and W. Merton Prunty, Trustees, and default having been made pursuant to said Deed of Trust, said Substitute Trustee, Paul J. Prunty. as Trustee, having been requested so to do by the owner and holder of said indebtedness, shall sell to the highest and best bidder, on Monday the 14th day of June, 2021, at I 0:00 a.m., at the east front door of the Courthouse of Wayne County, West Virginia, the real estate in Wayne County, West Virginia, and described as follows: All that real estate situate in Union District, Wayne County, West Virginia, located on State Route 37 and being more particularly described as follows: BEGINNING for reference purposes only at a pipe set in the Easterly right of way of State Route 37, said pipe being in the Southwesterly comer of Lot No. Two (2) of Elmwood Estates and also being in the Southwesterly corner of the 2.65 acre tract as described in Deed Book 513, Page 316, recorded in the Office of the County Commission of Wayne County, West Virginia; Thence from said BEGINNING, continuing with the Easterly right of way of said road, N. 05 22′ 00″ E. 295.22 feet to a metal pipe set in the Southerly line of a 15 foot private drive, said pipe being in the Northwesterly comer of Lot No. 6; Thence continuing with said line of said 15 foot private drive and leaving the said Easterly right of way of said State Route 37, S. 84 45′ 05″ E. 184.91 feet to a pipe set in the Northwesterly comer of Lot No. I 0, herein conveyed, of said Subdivision and being the TRUE PLACE OF BEGINNING for this description; Thence from said TRUE PLACE OF BEGINNING, continuing with said line of said 15 foot private drive and leaving the said Easterly line of Lot 8, S. 84 45″ 05″ E. 92.74 feet to a pipe set in the Easterly line of the aforementioned 2.65 acre tract and being in the Westerly right of way line of the old county road; Thence leaving said line of said drive and with the Westerly line of the old county road S. 11 28′ 58″ W. 108.88 feet to a pipe set in the Northeasterly corner of Lot No. 3 of said Subdivision; Thence leaving said line of said old county road and with the common line of said Lot No. 3 S. 81 57′ 10″ W. 88.78 feet; thence N. 09 31′ 16″ E. 104.19 feet to the place of BEGINNING. Containing 9,642 square feet or 0.221 acre and being all of Lot No. 10 of Elmwood Estates. (See Plat Attached to deed dated the 29th day of July, 1991, and recorded in the Office of the Clerk of the County Commission of Wayne County, West Virginia, in Deed Book No. 543, Pg. 485). TOGETHER, WITH. the mutual right to use that certain fifteen (15) foot wide private roadway as shown and designated on said plat. EXCEPTING, HOWEVER, from the operation of this conveyance, all the minerals, and mineral rights and privileges in, on, and under the above-described real estate; TERMS OF SALE: Cash in hand on day of sale, subject to real property taxes assessed and unpaid against said property.
