PUBLIC NOTICE OF UNIFORM ENVIRONMENTAL COVENANT ACT-LEAKING UNDERGROUND STORAGE TANK PROGRAM SITE CLEANUP METHOD PUBLIC NOTICE NO.: UECA-LUST #10-044 NEWSPAPER: Charleston Gazette-Mail PUBLIC NOTICE DATE: May 19, 2021 The Office of Environmental Remediation (OER) at the West Virginia Department of Environmental Protection has approved a cleanup method to address environmental conditions at Jet Stop under the Uniform Environmental Covenant Act-Leaking Underground Storage Tank Program (UECA-LUST #10-044). The applicant, Green Oak Corporation, has been working with the WVDEP since negotiating a UECA-LUST Agreement on August 26, 2013. The site is located at 800 Greenbrier Street, Charleston, Kanawha County, West Virginia, and is comprised of approximately 0.53 acres of property. The Site has been used as a retail petroleum service station since the late 1960’s. Currently, two retail retail spaces are attached to the service station building. The underground storage tank (UST) system consists of two 6,000 gallon capacity gasoline tanks, one 6,000 gallon capacity diesel tanks, and four dual sided dispenser units. In September 2010 and petroleum release was identified at the Site. Initial abatement included ventilation and repair of a combined storm and sanitary sewer line which extended across the Site, beneath a dispenser unit. Site assessment activities included collection of soil, groundwater and soil vapor samples. Impacted soil was limited to the areas immediately surrounding the dispenser pumps, while groundwater impact was limited to the tank pit and one groundwater monitoring well. A risk assessment conducted on the site indicated a need for institutional controls, restricting residential and groundwater uses. An additional release occurred at the facility in April 2018. Additional assessment and remediation will occur under the Leak ID #18-008. Additional institutional controls due to the more recent release include restricting excavation, drilling or penetration of the ground surface, and a requirement for vapor barriers and/or ventilation systems for any newly constructed buildings. A land use covenant (LUC), limiting the future use of the property to non-residential use, prohibiting extraction of groundwater for any other purpose except monitoring, prohibiting excavation, drilling or penetration of the ground surface unless approved by the WVDEP, any activity that may interfere with the groundwater monitoring well network, and construction of a building without a sub-slab vapor barrier and/or ventilation system adequate to prevent exposure to vapors in soil and groundwater, and an engineering control to keep the existing concrete cover in place and in good condition has been recorded at the Office of the Clerk of the County Commission of Kanawha County. Upon completion of remediation, the applicant will submit a Final Report, documenting that all work is complete. Site assessment activities have included soil, groundwater and soil vapor sampling. Contaminants of Concern: Contaminants of concern include Surface soil: benzo(a)pyrene, benzo(b)fluoranthene; Subsurface Soil: benzene, ethylbenzene, xylenes, naphthalene; Groundwater benzene, methyl tert-butyl ether, tert-butyl alcohol, benzo(a)anthracene, benzo(a)pyrene, benzo(k)fluoranthene, chrysene, dibenzo(a,h)anthracene, indeno(1,2,3-cd)pyrene, and naphthalene. Remediation Standards and Exposure Control Methods: A site specific risk based standard was used to evaluate surface soil, subsurface soil, and groundwater impacts. No sediments or surface water were present at the Site. An ecological de minimis screening evaluation was prepared as a part of the risk assessment. No further assessment was necessary. Institutional controls prohibit residential purposes, the use or extraction of groundwater for any purpose, except for groundwater monitoring and/or remediation, prohibiting excavation, drilling or penetration of the ground surface unless approved by the WVDEP, any activity that may interfere with the groundwater monitoring well network, and construction of a building without a sub-slab vapor barrier and/or ventilation system adequate to prevent exposure to vapors in soil and groundwater.
