NOTICE OF SUCCESSOR TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustees, James W. Lane, Jr. and R. Douglas Calderwood, by that certain Deed of Trust made by Paulette M. Dickey and Richard R. Carnefix, dated June 16, 2005 and recorded June 30, 2005 in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book 3259 at page 290, the said Successor Trustees acting by virtue of that certain Appointment of Successor Trustee dated May 16, 2018 and recorded May 21, 2018 in the aforesaid Clerk’s office in Trust Deed Book 4306, at page 134, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Kanawha County, West Virginia, on July 7, 2021 at 9:00 a.m., all that certain lot, piece or parcel of real property, together with improvements thereon, situate in Charleston, Elk District, Kanawha County, West Virginia, being more particularly bounded and described as follows: And being more particularly bounded and described as follows: BEGINNING at a No. 5 rebar found in a graded road which was originally intended to have been built within a 35′ right of way leading to U.S. 119, said point being located at the northeasterly corner of that certain 8.063 acre parcel of land currently under contract to John Jones and Jaime Kendall; thence S. 81-57-30 W. 599.64 feet, leaving the said road and running with the said 8.063 acre parcel to a 1/2″ galvanized pipe found in a fence, a corner to a 15.661 acre lot owned by Joe E. And Pamela P. Smith in Deed Book 1786, at page 754; thence N. 34 55 W. 481.21 feet, leaving the said 8.063 acre parcel and running with the said Smith parcel to a 1/2′ galvanized pipe found, a corner to the Smith and property owned by Wiseman; thence N. 80-32 E. 816.01 feet, leaving the said Smith and running with the said Wiseman to a No. 5 rebar set on the northeasterly side of a graded road which was intended to have been located within the aforementioned 35′ right of way; thence S. 55 – 45 E. 90.20 feet, leaving the said Wiseman and running across the said graded road to a point in the southwesterly side of same; thence following the westerly side of said 35′ right of way the following four courses and distances: S. 44 – 38 E. 65.54 feet, S. 5-08-30 E. 55.09 feet, S. 14 – 43- 30 W. 203.82 feet and S. 3-34-30 W. 96.63 feet to the point of beginning, containing in all 7.728 acres, more or less, and being all of Tract G, all as more fully shown on a map or plat thereof entitled, “Plat showing a 7.728 Acre Parcel of Land on Elk River Elk District, Kanawha County, West Virginia Now Owned by Arco P. Sharp & Hazel Sharp, Scale 1″ = 50′, October 12,2001”, as surveyed and mapped by William R. Gunnoe, Registered Professional Surveyor, a copy of which map is of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2542, at page 212. At the time of execution of the deed of trust, the grantor represented that the address of the property was 3895 Pennsylvania Avenue, Charleston, WV 25302. The sale is subject to the redemption rights held by the United States Internal Revenue Service as set out in 26 USCA Section 7425(d)(1). TERMS OF SALE: The Premises will be sold “AS IS, WHERE IS,” in its present condition and with all faults and defects, if any. The Premises will be conveyed by deed with no covenants of warranty of title. The Premises shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The Premises shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground. The Premises will be sold for cash in hand on the date of sale to the highest bidder. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Successor Trustees and United Bank shall not be responsible for the removal of any person or personal property from the Premises. Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
