NOTICE OF TRUSTEE’S SALE Notice is hereby given that by virtue of the following deed of trust: Deed of Trust dated July 30, 2013, executed by Jason R. Sturgill to Christopher J. Plybon, Trustee, to secure Community Trust Bank, Inc. in an amount not to exceed $79,726.00, recorded August 7, 2013 in the Office of the Clerk of the Cabell County Commission of Cabell County, West Virginia, in Trust Deed Book 2498, at Page 612. Said deed of trust was modified by Modification of Deed of Trust dated July 25, 2018, executed between Jason R. Sturgill and Community Trust Bank, Inc., recorded August 16, 2018 in the aforesaid Clerk’s Office in Bonds, Contracts, and Leases Book 395, at Page 254. Default having been made in the payment of the obligations secured by such deed of trust, the undersigned, Christopher J. Plybon, Trustee, having been required to do so by Community Trust Bank, Inc., the owner and holder of the obligations secured by such deed of trust, and having full and absolute power and authority in the premises, will on the 10th day of December, 2019, at 10:00 a.m. Eastern Time, offer for sale and sell at public auction, for cash to the highest bidder, at the main (north) front door of the Courthouse of Cabell County, at 750 Fifth Avenue, Huntington, West Virginia, the following described property: A certain lot and piece of lot of real estate, situate on the southerly side of Twenty-Sixth (26) Street, in the City of Huntington, Cabell County, West Virginia, bounded and described as follows: Parcel One: The whole of Lot Number Eighteen (18) and the one-half (1/2) of Lot Number thirty-seven (37) adjoining the said Lot Number Eighteen (18); Lot No. Eighteen (18) fronts 31.35 feet, and one-half (1/2) of Lot No. thirty-seven (37) fronts 15 feet on said Twenty-sixth Street, and both run back 100 feet, making a total of 46.35 feet in width by 100 feet in length; said lots are shown and designated on the Map of Davis Street Sub-division made by R. W. Breece, Civil Engineer, which map is recorded in the Clerk’s Office of the Cabell County Court, West Virginia, in Map Book No. 2, as Map No. 275. Parcel Two: All that ce1iain lot, piece or parcel of land situate in the City of Huntington, Cabell County, West Virginia known and designated on the map of Davis Street Subdivision, a copy of which map was filed for record in the Office of the Clerk of the County Court of Cabell County, West Virginia, on the 26th day of November, 1924 and was therein recorded in Map Book 2, as Map No. 275, as Lot Number Seventeen (17), and being more particularly described as follows, to- wit: BEGINNING at a point in the south line of Twenty-sixth Street at the corner between Lots 17 and 18 as shown on said map, thence with said line of Twenty- sixth Street easterly 32 feet to a corner between Lots 16 and 17 thence with the line between said lots southerly 100 feet to a point in the north line of Lot 22, thence with said lot line westerly 32 feet to a point in the line between said Lots 17 and 18, thence with said line, northerly 100 feet to the point of BEGINNING, RESERVING therefrom as an easement the southerly or rear ten (10) feet. Parcel Three: All that certain piece or parcel of land, situate in the City of Huntington, Cabell County, West Virginia, known and designated on a map of Davis Street Subdivision made by R. W. Breece, Engineer, filed in the Office of the Clark of the County Commission of Cabell County, West Virginia, on November 26, 1924, in Map Book 2, as Map 275, as the westerly 15 feet of Lot 16 of said Subdivision. Being the same property conveyed to Jason R. Sturgill and Robin A. Sturgill, husband and wife, by Barry A. Beckett a/k/a Barry Beckett a/k/a Barry Allen Beckett, by deed dated April 9, 2010, recorded April 9, 2010 in the Office of the Clerk of the County Commission of Cabell County, West Virginia in Deed Book No. 1213, at Page 442. Also being the right, title and interest in the same property conveyed by Robin A. Sturgill to Jason R. Sturgill, February 8, 2013, which deed is of record in the Office of the said Clerk in Deed Book 1275, at Page 46. TERMS OF SALE: 1. Cash in hand paid on the day of sale. 2. The sale is made “where is, as is” with no warranty whatsoever. 3. The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the prope1iy, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 4. Subject to any and all assessments and taxes against said property, and all matters of record in the aforesaid Clerk’s Office senior in priority to the deed of trust under which this sale is being made, including without limitation all prior liens and encumbrances of any nature whatsoever, including, without limitation, the liens for ad valorem real estate taxes for tax years 2017 and following. 5. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 22 of Chapter 11 of the West Virginia Code. 6. If the sale is set aside, the purchaser at such sale may be entitled to only a return of the amount paid less any applicable fees and costs and shall have no further recourse against the Trustee, the Beneficiary, or any other person or entity. 7. The Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of sale described above or any adjournment thereof.
