NOTICE OF TRUSTEE’S SALE Under authority of that certain Deed of Trust dated July 9, 2009 from Daniel John Rucker and Amber Danielle Rucker to Casie McGee, Trustee, of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book No. 3666, at page 956, securing a promissory note in the principal amount of $110,093.82, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Substitute Trustee will offer for sale at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on August 25, 2021 at 8:45 a.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, all that certain piece or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate on the waters of Wills Creek, in Big Sandy District, Kanawha County, West Virginia, more particularly described as follows: Beginning at a cross mark on a flat stone found on a point at the common corner between the property of Charles Withrow in Deed Book 1446, Page 725, the property of Reece Riggs in Deed Book 1373, Page 339 and Deed Book 1711, Page 175 and the tract of which this conveyance is a part, thence N 85-00E 261.43 feet, leaving the said Withrow and running with the said Riggs along the old fence line to a point; thence S7-16E 55.33 feet, leaving the said Riggs and running through the property of which this conveyance is a part to a point; thence S67-43-30E 156.04 feet, running down the hill through the property of which this conveyance is a part to a point on the northerly side of a graded road leading to a water well; thence following above the said well S69-22 W. 97.85 feet to a point at the westerly terminus of a thirty foot wide right-of-way for ingress and egress to the herein conveyed property; thence S62-52-30W 168.11 feet, running along the northerly side of said road to a point; thence S70-59W 182.32 feet, running partially along the northerly side of said road to a point in the common line between the aforementioned Withrow and the tract of which this conveyance is a part, said point being further located N. 0-22-30E 272.30 feet from a 24″ double hickory with one dead fork found in the old fence line at an agreed corner between the Grantors herein and the aforementioned Withrow; thence N0-22-30E 261.78 feet, running up the hill with the said Withrow to the point of beginning, containing in all 1.568 acres, more or less, all as shown more fully on a map or plat thereof entitled “Plat Showing a 1.568 acre parcel of land being part of a 10 acre tract on Wills Creek Big Sandy District, Kanawha County, West Virginia to be conveyed to Daniel John Rucker and Amber Danielle Rucker Scale 1″ = 100′ March 11, 2009” as prepared by William R. Gunnoe, Registered Professional Surveyor, a copy of which is made a part of this instrument. Together with a non-exclusive right-of-way thirty feet wide leading from the herein described parcel of land to Jordan Creek Road or Kanawha County Route 55, said right-of-way to be used for ingress and egress and such other uses as may be deemed necessary, being shown more fully on the aforementioned map or plat. Being the same property conveyed from John R. Rucker to Daniel John Rucker and Amber Danielle Rucker by Deed dated March 25, 2009, of record in the aforesaid Clerk’s office in Deed Book No. 2745, at page 954.
