TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated May 25, 2006, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 3359, at Page 58, Gregory Allen Patterson and Regina Gail Patterson did convey unto Janet Phillips, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated May 7, 2021 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wilmington Savings Fund Society, FSB, not in its individual capacity but solely as Owner Trustee of GAMLT 2017-RPL1 Trust to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on August 24, 2021 at 11:00 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Loudon District, Kanawha County, West Virginia, and more particularly described as follows: All of that certain lot or parcel of land, together with the improvements thereunto belonging, situate on Lens Creek in Loudon District, Kanawha County, West Virginia, about 1-1/2 miles East of Hernshaw, known, designated and described as a part of Lot No. Eleven (11) as shown upon a map entitled Lots Out of a Part of Parcel 39-St, George Property on Lens Creek, Loudon District, Kanawha County, W. VA., dated July 10, 1959, made by J. Lewis Hark, Reg. Prof. ENGR., and duly filed for record in the Office of the County Commission of Kanawha County, West Virginia, in Map Book No. 19, at Page 106, and being more particularly bounded and described as follows: Beginning at an iron pin in the Southerly line of W. VA. State Secondary Route No. 68, which said iron pin is located S 71 Deg. 33 min. E. 2.00 feet from the common front corner of Lots Nos 10 and 11 of said subdivision; thence with the Southerly line of said W. VA. State Secondary Route No. 68, S. 71 deg. 33 min. E. 38.00 feet to an iron pin at the front common corner of Lots Nos. 11 and 12 of said subdivision; thence with the dividing line between said Lots Nos. 11 and 12, S. 21 deg. 00 min. W. 233.30 feet to a stake at the rear common corner of said Lots Nos. 11 and 12; thence with a part of the rear line of Lot No. 11, N. 58 deg. 55 min. W. 38.60 feet to a stake; thence with a line running through Lot No. 11, Two (2) feet from and parallel with the division line between Lots No. 10 and 11 of said subdivision N. 21 deg. 00 min. E. 223.96 feet to the place of beginning. Map No. 27A and Parcel 44. Being the same property conveyed by fee simple deed from Mable M. Atkins, widow to Gregory A. Patterson and Regina G. Patterson, dated 12/28/1994 recorded on 03/02/1995 in Book 2358, Page 156 in Kanawha County Records, State of WV. At the time of the execution of the Deed of Trust, this property was reported to have an address of: Rte 81 Box 201, Marmet, WV 25315. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
