NOTICE OF COMMENT PERIOD FOR 45CSR28 EMISSIONS TRADING PROGRAM EVALUATION The West Virginia Department of Environmental Protection, Division of Air Quality is providing notice to the general public of its emissions trading program evaluation. The emissions trading program is a voluntary statewide program which provides incentives for air pollution sources to make progress toward the attainment or maintenance of the National Ambient Air Quality Standards, the reduction or prevention of hazardous air pollutant emissions and the protection of human health, welfare and the environment. Under the provisions of 45CSR28 “Air Pollutant Emissions Banking and Trading,” the Director is required to conduct an evaluation of the emission trading program. This notice solicits comments from the public concerning the evaluation. All written comments submitted by the public pursuant to this notice must be received by the DAQ within thirty (30) days of the date of publication of this notice. In the event that the 30th day is a Saturday, Sunday, or legal holiday, the comment period will be extended until 5:00 p.m. on the following regularly scheduled business day. During the public comment period, any interested person may submit written comments on the evaluation and may request a public hearing. A request for a public hearing shall be in writing and shall state the nature of the issues proposed to be raised in the hearing. The Director of the DAQ shall grant such a request for a hearing if she concludes that a public hearing is appropriate.
