NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated September 13, 2006, executed by Borrower(s), Kimberly S. Stutler and Robert L. Stutler, to Robert P. Howell, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 3393, at Page 934. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 380 Frame Road, Elkview, WV 25071. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated May 17, 2021, of record in the Clerk’s Office in Book 4511, Page 824. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 17th day of September, 2021 at 10:30 a.m. All that certain lot or parcel of real estate, located on the waters of Little Sandy Creek, Big Sandy District, Kanawha County, West Virginia, and bounded and described as follows: BEGINNING at a stake, on the south side of Little Sandy Creek, in the line of West and Chapman and running with the same N. 63 W. crossing Little Sandy at 4 poles in all 10 poles to a stake on the North bank of Little Sandy; thence S. 84 1/2 W. 18 poles to two beeches (now gone), corner to Good and Chapman and West lands; thence running with the State road N. 75 1/2 E. 15 poles to a stake; thence continuing with the State road, S. 88 E. 12 poles to a stake; thence leaving State road S. 1 1/2 W., crossing Little Sandy at 2 poles, in all 5 poles, 7 links to the place of beginning, and containing 54 square rods more or less. And being the same property conveyed unto Beverly Kay Wehrle by Beverly Kay Wehrle, Thayer L. Dodd, David D. Dodd and Arley D. Dodd by deed dated December 11, 2001, of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2652, at page 945. And also being the same property conveyed unto Robert L. Stutter and Kimberly S. Stutler, his wife, by Beverly Kay Wehrle by deed dated September 13, 2006, to be recorded simultaneously herewith in the aforesaid Clerk`s Office. The above described property is subject to the following: (a) out-conveyance therefrom of Lot “A” containing 2,198 square feet, more or less, conveyed by Vesta L. Dodd, widow, to Billy Joe Wehrle and Beverly Kay Wehrle, his wife, by deed dated March 24, 1984, of record in the aforesaid Clerk`s Office in Deed Book 2062, at page 674; (b) 12 foot right-of-way granted by said Vesta L. Dodd, widow, to Judy L. Strickland and James E. Strickland, her husband, by deed dated August 9, 1977, of record in the aforesaid Clerk`s Office in Deed Book 1839, at page 16; and (c) 12 foot right-of-way granted by said Vesta L. Dodd to David E. Nichols and Rhonda Nichols, his wife, by deed dated April 5, 1983, of record in the aforesaid Clerk`s Office in Deed Book 2028, at page 791. This conveyance is made subject to any and all covenants, restrictions, and easements as the same may appear in instruments of record in the aforesaid Clerk`s Office. Being the same property conveyed to Robert L Stutler and Kimberly S Stutler by the Deed dated September 13, 2006 and recorded in Deed Book 2669 at Page 484 in the Office of the Clerk of the County Commission of Kanawha County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
